andm09-19 09:06 PMI entered US with a tourist visa in California. Months later, I got married to a US citizen in Austin,Texas. Me and my husband were apprehensive at first to get an immigration lawyer to process my visa but we realized the process of obtaining a visa was not as straight forward as we thought.

We have since decided to hire a lawyer and have met with two attorneys so far. The process is frustrating because of the requirement to pay a consultation fee; we schedule an appointment, meet, and find out that the cost of hiring the lawyer is far greater than what we can afford.

My question is: does anyone know of a good lawyer who charges a reasonable flat fee? $1000 - $1500?

martinvisalaw05-13 11:50 AMI think you need to have a consultation with an immigration lawyer, if you want a legal opinion from someone other than your current lawyer. There isn't really enough information in your question to give an answer. Without knowing why the L-1A petition was denied, it's very hard to suggest a strategy. If there was an RFE issued before the denial, you should be able to see what CIS was concerned about.

Are you eligible for E status? I don't know your nationality, so can't answer this myself.

What if my employer cancels I140 and I don't have any other job on my hand? This can be a possibility for me in near future. I am searching for a new job and my employer is going to cancel I140.

Is it good to wait for any RFE or denial and if it occurs, just sending them new EVL of any consulting firm (with or without project) will help?

Yes, she can not work until she files another h4-h1 (cos) - you will not be subject to cap, you can do that any time after she enters.

If an employer withdraws an approved I-140, is it enough to show a future offer of employment letter to keep your 485 alive?

My particular case: I have an approved I-140, with pending 485 (EAD/AP approved) (6 months have elapsed). I want to quit my job and go back to school this August, but want to keep 485 alive (primarily because my 6 years on H1 are up). I can easily get a letter from an employer saying that they will employ me once my GC is approved (and I can join them when GC comes through). However, my current employer says that they will withdraw 140 (routine procedure).

Questions:
1. Can I study on EAD/parolee status?
2. Do I need to inform USCIS of invoking AC21 since my employer will withdraw my 140?
3. Can I claim that I am waiting for my GC to be approved to join my future employer, and in the mean time, I am studying full time to improve my skills?
4. Should I try to maintain my H1 status during school (by working part time etc.)?
5. Does my future employer need to file an I140?
6. What should I ask my current employer to provide? Eg: copy of 140, Employment verification letter etc.

Please provide your insights. There might have been previous discussions on this topic. If so, please point me to them and my apologies in advance for re-posting.

Will appreciate any suggestions / comments. I am stuck with the dilemma of continuing to work or going back to school.

arihant04-02 10:58 AMI feel bad for you. Given that nobody has responded to you yet, i am guessing not many are experiencing similar problems.

Try the following:
1) Talk to your lawyer and see if contacting your local congress person would help you.
2) Post in other forums as well such as murthy.com and immigrationportal.com.

Good luck. The whole GC process is very stressful when everything is progressing without a hitch. So, I cannot imagine how much more stressful it must be when things get screwed by BEC and/or USCIS.

My Case:
I am planning to travel to India from 11-March till 27-March and my current petition(VISA) ends on 5-April. My company already filled for the extension process (on 30-Jan).

Three possible scenarios

1. If I get the extension approval before leaving to India, do I have to set up a stamping slot at the US consulate in India or can I just carry the new petition and while entering back in US just show that to the immigration officer.

2. If the approval comes on 26-March, what should I do, can I still travel to US without the new stamping.

3. If I dont get the approval till 27-March, can I travel to US with my old petition without any problem?

I think there is no way you can take your priority date with you just with labour approval.

I mailed it to NSC on aug 3rd nothign yet..

Sorry to hear that....Mine is TSC and They receieved my Applications on Aug 13, 2007. But One of My friend Filed with NSC and They receieved his application on Aug 16, 2007. His Check got cleared couple of days before.
