krishna_brc07-30 04:37 PMMy PD is Feb 2008 and my I-140 has been approved the same year. I am on my H-1b 3 yr extension.
If I were to change my job now, will I lose my PD or can the new company refile my new I-140?


Read somewhere in forums that one can retain PD as long as pervious employer does not withdraw the approved I-140.
Also I-140 is based of future job.... so no worries as long as you work based of your H1.

Check out the universities that are approved by SEVIS.

I saw about it on CNN yesterday. A bipartisan bill is being proposed in the house (Some thing like 41 DEMS and 47 REPs) are sponsoring and they expect the number to reach 100 in a day or two.

Looks like the focus of this bill is just securing the borders and has potential to pass. It appears it is a great opportunity (If possible) to add some recapture provisions to this. Is IV working on it ? It is alright if it is being discussed in State Chapters and can't be disclosed here, please say so.

milestogo03-31 01:27 AMI would suggest to apply for the extension now and atleast carry a application receipt with you. And if you are planning to enter the county in July - Sug time, frame, I would suggest that you carry the approval notice as well.

I had the same issue with H1B. Even through my H1B was valid but it was expiring within a months time when I was re entering US after a business trip. I was suggested by my lawer to carry the H1B extension approval notice.

I moved to a different place (same city), but my wife is out of country. I am trying to file AR-11 for change of address, but it is asking for Last Port of entry. Is AR11 needed only for people who are currently in the country.

She needs to fill-in new address in the I-94 form at the time of reentry into the US. She won't need to file AR-11, as her I-94 has most recent address.

Please verify this with your attorney.

I am new to wpf. i am working on my project in WPF on 3d objects where i managed to add the functionality of zoom and rotate but struggling to add pan tool. can you please help me achieve that. I downloaded the 3dtools.dll from code plex website and added to reference in blend along with trackball codes therefore my zoom and rotate started working. But doesn't have pan functionality yet.

A review of your file indicates that you submitted a medical examination completed by designated civil surgeon. however, the civil surgeon failed to complete the immunizations supplement to Form I-693.

Please return to the civil surgeon so that civil surgeon can administer appropriate vaccinations.
I know she did not take Measles Vaccine as it she was pregnant that time.

My wife is currently in India. My questions are

1) Does she need to go through complete medical examination again? will it be enough to just send documentation regarding missing vaccine. (There is no info given in RFE regarding what is incomplete)

2) can she do any thing about medical exam in India. I mean can she get a certificate from India?

3) can we ask for additional time to respond to RFE? If yes is it Advisable and safe? How much additional time can be requested?

4) If she has to travel back, she has to travel on AP as My H1 transfer is pending. So my question is what happens if her H4 gets approved before she comes here. Does she need to apply H4 again?

5) If my H1 transfer does not get approved till she comes back, My understanding is, once H4 gets approved it automatically overrides Parolee status. Am i correct?

6) while coming on AP what documents she need to carry. Does she need to have My employement letter, any thing else?

I appreciate any help about my questions.

rajiv40412-09 06:11 PMI recently found a new job and they filed for my H1 transfer in premium processing. I am still working for my old employer. Now I have got an RFE questioning why my salary (in 2009 W2) which is less than what was mentioned in my previous petition. Even though I have all my paystubs I was on bench for few months between march - may 2009. I have a leave letter for 4 weeks vacation in may and my salary was reduced when I got new project. Which explains why it is less but may not be enough to prove it to USCIS. Salary in W2 could also be less that prevailing wage. Right now I have following scenarios
1. WIthdraw application - not sure repurcussion of this.
2. Respond to RFE with mentioned reason which can have following outcomes
a) Appoved - (good i will be more than happy)
b) Approved with consular processing - (I dont want to travel at this point of time outside US)
c) denied - (not sure)
3. This case goes to DOL and there may be investigation or indent of revoke sent to my employer. Can this happen?

Here are my questions
1. Senario 2.b. If I get "Approved with consular processing" do I have to travel to India for stamping immediately or just get new I94? What will be my current status then? What if I decide not to join the new employer?
2. Senario 2.c. If I get "Denied" what will be my current status?
3. What should I do so that I am not out of status and I dont have to travel to India for stamping?
4. Scenario 3, Can this happen?

Any response will be appreciated. Thanks!

She got a temporary green card to travel in a week or so which facilitated her entry into US and once she reached here, she just applied for another green card claiming the initial one as lost. There were no issues except the travel delay and the monetary loss.
