shx01-29 07:02 PMYou should only disclose class B misdemeanors and up. I would think that your citations are class C misdemeanors, which are same as traffic violations. I don't think you are required to disclose those, unless you got arrested, taken to court, etc. Just my opinion.

I'm not sure the need of physical office for GC, but for H1 transfer and extns you may get RFE for office photos, lease agreement (notarised copy) etc.

I was on H-4 till my wife got the green card - however, I have been told that the H-4 is invalid as soon as the primary applicant receives the green card. I have received my EAD Card and I have completed the FP. For whatever reason, the lawyer did not apply for I-131 till Oct 12, 2007. Now he says, it will take 90 days. What documents should I be carrying while traveling to India to travel on AP (if I ever get one). Any response will be highly appreciated. Please help.

I am on F-1 visa since Jan 2007. and got started my OPT in August 2009. I have on campus income through out the year in 2009. so how do I file the taxes, n which forms. for tax return 2009.

also I got married to a F-1 student in Jan 2009. She is also having her OPT started in August 2009. She has income only on OPT (from Aug to Dec 2009) so which forms she should also file.

my wife did paid her college fee in Jan 2009. and we have paid the rent through checks on leased apt.
So can she/we ask for deduction of any kind?

also which status we have to fill in. "Married filing jointly/separately".

Suggesion to file 'Married filing jointly'.

If both of you having 1098 forms from school you can file for Hope-credit (each gets $2500 credit, thats huge amount :) ). You cannot show the Apt. on tax form.

GCVivek03-29 05:13 PMThere is no 6-year H1B visa. There is only 3-year H1B visa that can be renewed again for a total of 6-years stay on US soil. If you have spent 5 years on US soil and your tourist visa visits add ip to say 5 months, you still have 7 months on your H1B term. Even if you get a new visa it will be only for 7-months validity. Sometimes, USCIS makes a mistake and issues new 3-year visa but that is a gamble. Why not just stay off-US soild for a few months?

I left the US for good after spending around 5 years on H1-B sometime last year and have only made entries on tourist visa. Can I apply for a new 6 year H1-B quota since leaving the H1-B status last year or will I have to spend 1 year outside since the last tourist visa entry ?

I am trying to understand the relationship between the Customer Service agents, IOs and the case workers.

My understanding is:

Customer Service Rep (Level 1) - has access to little more information (like insights on processing times) than what you see online.
Customer Service Rep (Level 2) - has more access priviledge than CSR1, most of the time, s/he helps you open a high serverity service requests and/or direct your call to right resource to have your questions answered.
Immigration Officer (Customer Service) - Most of the people who use POJ end up in reaching IO CS, who has more insights about the case details (workflow, cards ready to be printed and etc), s/he will help you resolve the isssue or answer the question on hand.
Immigration Officer (Case Adjudication) - the one who is acutally working in the case, whom you will never be able to reach through POJ but It is possible to have your call routed through CSR2 or IO-CS - it all depends on your case issue and planet alignment.

Immigration Officer (Customer Service), Immigration Officer (Case Adjudication), the titles in the bracket are made up names to distingush the role. Long story short, both are immigration officers with different roles and access.

thomachan7202-03 05:08 AMThere should not be any issue for applying with only 2 months left. If you wait to get the next approval notice and go for stamping closer to the starting date of your next year of H1b you could get stamp for the next period too.
If there is 2 months or above left on the current extension then they will not give a visa including the new approval period. They will give only for the 2 months. So perferably go closer to the begining of the next period along with the new aproval notice (if you want to travel freely for the next period too)
