kadarm12-12 06:10 AMMy I-140 is applied during Jan 2007 under EB2 category. My LCA says Masters with 24 months experience amd alternative as Bachelors with 5 Yrs experience. As per the processing time updates, they are processing March 21st 2007. I don't see any updates other than Case is pending.

What should I do to get this processed?. Should I call customer service and ask for SR?

Applied for EAD renewal and documents reached on May7th.. checks not cased yet. I think the whole lockbox is creating the delays but one they get to your application it is relatively quick.

Do let me know when your checks are cased.

My dirty employer has been hiding this fact from me for the past two months. I have been waiting all these days, hoping that my I140 will be approved one day, checking case status almost daily etc. I am really really mad now. :mad::mad::mad::mad::mad::mad::mad::mad::mad::mad: :mad::mad::mad:

CRIS still shows that my case status as application received and pending, although there was a soft LUD on august 27th on my 140 application, which is the approval date of my 140. I failed to understand the meaning of the soft LUD at that time, but now I know. So, my dear friends, do not rely on CRIS for updates. Please check with your employer/attorney to get the latest status.

1. Are you responsible for invoking the AC21 or the new company that hires you does that?

yes, if you want to use H1B. Else use EAD it is your choice

4. If wife has started using her EAD, how does that get affected?
no, problem, if you are still on h1b then she can always fall back to h4

5. Can you continue to use the AP issued or do you have to have a new AP re-issued?
you can use AP issued.

I came to the US on H4 and then applied for H1-B. My H4 visa expired. My H1-B was approved but I was not staffed and hence not paid for the past one year and as a result I do not have pay stubs. I do not have the H1-B stamping on my passport. Now I want to apply for H4 from my home country based on my husband's H1-B.

My question is when I fill in the DS156 form what should I fill in for the following parts

1. #20 and #21 - Name and address of you current employer and Present Occupation
(Would I have to give details about the employer who filed my H1-B even though I do not have H1-B stamp on my passport)

2. #30 Have you ever been issued a US Visa - Yes/No (I do not have the H1-B stamp, I only have the previous H4 stamp)

When , Where, What Type of Visa (Would I have to mention about my H1 or H4?)

Please can anyone help me with these questions

Suppose if I am entering US on Advanced Parole(I-131), what will be the validity enddate for I-94? If suppose they give for 1 year how to extend that if i am not going out-off US?

gc_chahiye07-15 01:54 PMthat is old stuff and also scary stuff for some people, even if old visas's are being recaptured, it was being done only for Schedule-A folks (nurses). So for all other EB categories where the only form of relief they are seeing is from possible recapture, if nurses take away those 200k (per Ombudsman its about 218K lost visas) then thats another big hope gone.

In case I accept the job offer do I need to withdraw my pending I485?. If will work part time with my current employer will my application be affected in any way?
