I am on H1B visa currently, set to expire in two months from now (end of September). I need to get my H1B renewed for the next 3 yrs. Due to unavoidable reasons my lawyer has not been able to file for the renewal yet.

My questions are -
1. Do I need to have the approval notice before my expiration date?
2. I plan to travel internationally in November. Would the receipt notice be acceptable to reenter? Or do I need the approval notice?

Any suggestions are most welcome. Thanks in advance.

I am in the same boat. My 140 is pending. I am on H1 wife is already employed with EAD (After getting SSN). According to my attorney Her getting SSN and working will not have impact on My h1.

Why do you want your spouse to continue on h4?

Regarding A# on I 140, if you've missed that in your 485 application, it's no big deal as long as you've sent a copy of your I-140 approval notice that has the A# mentioned in it.

rayen06-12 01:27 PMI am going to file application for renewal of EAD of my spouse.She was on H-4 when she came to USA and she got EAD last year. She will start working from Aug 08. She has not used her EAD till now but went to India on AP.

1.What is manner of last entry and the current immigration status for her? Is it Parolee or H4 status in both cases?
2.I have filed I-485 after July 2007. Can I E-file? As I read somewhere on forum that On or after July 30, 2007, applications may not be electronically filed and must be submitted to a Service Center via regular mail or courier service.

1. If your wife used AP @ POE then Parolee ( AOS - Pending)
2. You can e file but you have to go for FP.

Am I going to have any problems because I did not extend my visa and applied for a fresh one instead?

Any delay due to PIMS? Do I need to check whether my petition number is in PIMS system?

richana08-05 09:45 PMMy interpretation is that that there is no appeal due to the fact she has applied early, she can apply again after the 90 day clock starts ticking and she should be good. If she gets a denial again I suggest using a lawyer, there are many on this site itself in the lawyers forum. But you seriously need to be talking about the specific type of the app if you need very precise answers because USCIS treats differnt apps well differently

I got my I140 denied and one attorney suggests that I can file for New I140 and also Appeal to AAO office at the same time, another one suggests that if appeal is filed USICS will not process I140 until the decision is made on Appeal, did any one file file both new I140 and Appeal at the same time and got result for I140 earlier than Appeal.
