I have a question about this. Suppose one had a labor and 140 approved from a company and wants to go to another company. can one file 485 with this other company ? It is for EB3 category.

The question is : If my h1 is with company A and my GC is applied for future employment by company B, can I use EAD to take up full time employment with company C (or Self) ?

The full story is : The client company, I am working with is processing my GC for future employment. 485 was applied and I received EAD. It has come up that the current employer has an agreement with the client that , the client should not employ any of their employees for 1 yr after the termination. So, I need to quit the current employment, work else where for a year and then join the GC sponsering company.The I140 will not be revoked.

Since I am not currently working for GC sponsring company, does any of the AC21 issues matter ?

yes you can take up employment with C. If you get an RFE at any point within the next 180 days make sure B can give you an employment offer letter. post 180 days you can invoke AC-21 if you want and use C as your GC-Sponsoring employer.

Need some comments on my situation. My lawyer filed for my I-140, I-485, AP, and EAD on November 20th on EB2 Row Category. I just emails yesterday stating that my EAD card is sent to production, but they have asked for initial evidence on 485. Is it possible to review 485 without looking at the 140? I am not sure what that query is, but really hoping that it is not something serious. I've already waited for 16 months for my Labor to get approved. Please share your experiences, suggestions etc. regarding this.

yes, 485 processing and 140 processing is different. They are joined thread, So they will not approve 485 until your 140 is approved.

I started acting when I was 11, almost as a fluke. You have 2 options. Either use your old H1 which is still valid (assuming u still have a valid visa stamp) and enter US (carry a latest offer letter from employer). If you use the old H1, then you will only have 2 more years of H1 time left.

You can file for a fresh H1 visa in Master's quota under consular processing and when its approved, attend the Visa interview, get a new H1 stamp, and re-enter using the fresh stamp. This way, you will get fresh 6 yrs time on H1.

Whats wrong with this.Ur last name is still Baru .In my old L2 EAD I see c,a b where c is my last name ,a my first name and b my middle initial.There should be a comma after your lastname in EAD card right?U r OK.

I did received my EAD and I-485 receipts.But my wife never received hers, on contacting USCIS I came to know they had my address wrong .Receipts & EAD are delivered to my neighbours mail box,it seems they trashed all documents, I don't know what else I can do.
Any help is appreciated.
