Similar experience at Mumbai Consulate. Being a full time employee, and after showing all paystubs, employment letter , VO was not satisfied. 1/2 of the time , he was under impression that I was still working for a company, whose visa was stamped in 2008. :)

Another reason of frustration is they did not check all the documents I sent , which were mentioned in the green slip. Inspite of sending Research Document, I had got the reply saying that I did not send the Past, Current and Future Research Statement. So I resubmitted all the documents again on Dec 23rd,2010 . also added I am not working on any research topic presently or in near future . After that I did not hear back from consulate. So that means my case has been under processing?

Did anyone get the receipt of documents submission in response to Green Slip?

Please let me know

if you invoke AC21 means you have to use EAD not H1B......

May I know the implications of this? What all are the possibilities ? Will they reject the application?

I140 is filed by your Employer and you don't need to sign it. Your Employer has to sign I140.

psaxena10-07 07:20 PMI did the same this one month back. All you have to do is the letter to USCIS telling them that your attorney will not represent your case in future and please mail all the communication directly to my registered home address.

Send this letter to address mentioned in I-797 Notice of Reciept of I-485 with acknowledgement return address card.

Look for my previous post related to this and you will find the sample letter as well.



Folks, Please let me know if anyone knows where to send G-28 form if one wants to revoke attorney and be one's own representative?

2. If you are out of university and if company A's H1 is valid, you can start work with company A.

If you are out of university and company A's H1 is valid, but you are not getting job or salary - you are out of status

If you are out of university and company A's H1 is not valid, you are out of stats.

Please check with attorney asap.
What Snathan said above is absolutely 100% correct.
However as someone else said about stamping and getting over the out of status period issues is not correct, if at any point you were out of status (no salary or no valid i-94 (white card or the 797)), it may come back to haunt you during GC process.
Without getting into the risk/debate of whether you were counted for cap when "A" filed for your H1, in order to file with another employer "C", it is advisable to work for "A" if they have a valid H1 filed for you and if you have just left the University employer without any delay and consult with an attorney to remedy the out of status issue for the period since you left the Univ. employer. + 3 years is correct, as thats what your H1 petition is for. You will get a 3 year multiple entry visa, thats the standard for H1.

+ no problem with your sister being in the US. The H1-B is a dual intent visa. Unlike a student visa or a tourist visa you are not required to prove any ties to INdia or convince them that you'll return. Dont take any support letter from your parents, its not needed. As long as you have a bonafide job offer from the US and your degree certificate etc are in order, you are good to go.
If they ask you if you'll come back, the answer is upto you: you can say yes, you can say you'll evaluate in 3 years if you want to return or extend for another 3 etc. Typically it does not come up because of the dual-intent nature of this visa.

PlainSpeak02-25 03:34 PMA friend of mine (GC) sent his and his family passports to DC embassy and they sent his wife's and one kids passports back to him and sent the remaining 2 passports to some one else in california. Fortunatly the person who received the passport was a nice guy and he called my friend and sent back the passports.
Bottom line is if you are in the tri city area (within a 100 miles of DC) its is better to go in person to the embassy to submit and pick up passport. Atleast you have peace of mind. For those who live far off there is no option but to post

If you create an app for the iPhone, you should be able to put it on the apple store and derive income from it, as long as you have not worked for someone (or yourself) deriving compensation financially, without authorization.

In short ... go ahead and do it. As sac-r-ten says go ahead and live your dream .. develop your apps, create wealth and dont worry about stupid man-made rules to encumber people ... :-)

PS : Please recommend a good objective - C / Cocoa book for Mac/iPhone programming..

It is illegal to derive income by selling iphone apps.
For F1 students, any off campus employment must be related to their area of study and must be authorized by your school's designated official...

I filed it for my wife. Please follow the following steps

1. https://efiling.uscis.dhs.gov/efile/ Register your by clicking on new user
2.After Registering it will ask you to select with forms you want to file online.
3. Select I-765 (EAD) file . Make sure you have the following information with you Passport number,Current I-94, DOB, A# number etc, H1B or H4 info ready.
4. Once you fill the form , it will ask for credit card information.
5. Once you submit the form . it will automatically generate LIN number for you.
6. Please Post that form to TSC or NSC what ever center you belong.
NOTE: Please do not post any other document unless asked by USCIS.
7. You will get Recipt number in One week also you will get Figure Print Notice the following week.

Hope this information will help you alot.

I did efiling for Myself and we got Receipt Notice is one week. Figure Print in next week and EAD in 11 weeks.

newlife209-19 10:15 PMGuys, I was just laid off and have efiled i539 3 days after the termination date for a status change to F2. Now working on the application letter. Do you think I should mention the layoff in the letter?

If I do mention it:

Con: The layoff might quickly catch the eyes of the immigration officer and if he want to check my status, he could find out the 3 days OOS.

Pro: My previous job was well paid. By mentioning it, I give the reason that why I want to stay at home as F2 instead of keeping the well paid job.


I guess I will mention it in the letter to explain the whole situation and hope everything will be all right. Let me know if anybody disagrees asap, I will mail out the stuff with in next two days.
