GCIssues07-24 07:40 PMI Left Company A on April 27, 2004. Joined Company B on April 28 through H1b Transfer as CompanyB told me that they have filed H1b transfer documents. Got H1b Approval in Few months; , The H1b approval notice shows a receipt date of May 15. CompanyA never reported my job termination to INS. Now i have left Company B and joined Company C. Can anyone comment on consequence of this 17 days gap on GC prospects and What is considered my employment start date for companyB and employment end date with CompanyA.

My company is using substituted labor for me and applying for 140 and 485. My original LC which was pending just got approved. But the physical documentation is not there.

But my company is saying that they will also apply for 140 for the original LC also. How is this possible? I'm confused. What will happen to the 485 (and the first 140) when they file second 140?

survu03-14 10:52 AMI am planning to use AC21 by joining a company on this March month end , I asked new company to process H1, and its in progress.
In APRIL Visa Billiton my PD is current, as I have PD of JUNE 2001( EB2), my RD - JUNE 29, 2007 .at this stage if I change company what is the impact on my GC approval. Should I wait for some more time to join the new company?
Your advices are appreciated

I am working for a company A with whome I have gone ahead and resigned with them i also filed my GC and 485 is still pending with them and also have EAD through them, recently i got offer from Company B which i accepted and they have gone ahead and filed my H1 Tranfer but recently i got one more offer from Company C which is much better.
What should be done in this scenario,should i again file for H1 Transfer through Company C or will it mess up my case even more

Join Company C since it is better offer. Look for your benefits..always.:)

EAD is employment authorization document. Your analogy is like -

"Can I use her driving licence to drive around town". I am not sure if that is what you meant.

If you want her to be the primary applicant in your GC application and then use EAD as a dependent, that is possible. You will lose your H1B status then.

1) I-140 approved in August 2008 (total > 180 days)
2) I-485 pending since July 2007 (USCIS receipt date of September 29 2007)
3) EAD valid till October 2010
4) H1-B valid till October 2010
5) PD: Feb 2007

Company A is in talks with company B for takeover of the division I am working in.

I have a offer in hand with company C. They have filed for ETA 9035 and if i understand it right, i have to use AC21 portability now

What I need to confirm is:
1. Takeover of company A's division by company B, will it affect my GC process? What can cause issues here?
2. If i stick with company A, it should be good for now, but maybe some layoffs after merger. Whats the best thing to do to maintain my GC process?

Please let me know as my join date for company C is next week

I got my H1-B visa stamped in the month of Feb 2007 from US consulate in chennai. I have not yet travelled on that visa, so I am wondering whether the same visa is still valid, as someone told me that if you don't travel on a visa for 6 months after stamping, it gets expired.
