lsuk07-21 07:17 PMEAD is usually issued only for one year but USCIS has the option to issue EADs for a longer period of time based on this regulation:

"DHS on July 30, 2004 published an interim regulation that amends 8 CFR sec. 274a3. USCIS now has authority to issue EADs for periods greater than one year. This regulation recognizes the system is overburdened. However, USCIS has not implemented this reform probably due to the potential revenue loss."

Source: "Immigration and Nationality Law Handbook 2007 Edition", published by AILA

This can be done without changing the law. If USCIS is afraid to lose its revenue they can change for 2 or 3 years ahead. I believe this may be a good choice for people whose visa number will not be available for several years. Any comments?

tampacoolie06-30 05:24 PMNothing make sense here, since USCIS itself preparing for large volume of I485 cases in July. They infact stopped the premium processing effective from July 2nd. So why they have to go back to stone age dates? Moreover, new fee gets effective from July 29 and if anyone files on/after July 29 do not required to shell out AP and EAD renewal fees during endless I-485 approval. If they get everyone filed before july29, then everyone end up with paying AP and EAD renewal fees for next decade. This would generate lots of positive cash flow for USCIS and immigration attorneys. So they must be generating this panic attack to make sure everyone file July first week or second week.

What a way to make some quick millions here :confused:

My question is, is it possible to even file for COS from H4 to F1 after getting F1 denied in India .

Here is the timeline

Nov 2010 - COS from H4 to F1 approved in US.
Dec 2010 - Went to india for F1 Stamping and it was denied.
Jan 2011 - Came to US on H4 visa .

Now is it possible to apply for COS to F1 again ? . Will the F1 denial in India have any impact on COS to F1 processing ?

I think Lawyers have a system where they can send emails to the service centers in a particular format, the receiving software at USCIS automatically parses the email and assigns the case to officers.

Or, if it has been a long time since it is current try contacting the Ombudsman.

I just got my EAD approved and I am waiting for my AP. I want to go back to school full time to pursue more education. If I do so, what will happen to my immigration status?

Can I continue on my EAD? If yes, How?
If I transfer to F-1, what will happen to my PD, EAD and AP?
After completion of studies, can I utilize my PD or EAD?


Please advice!


I presume you can continue your studies using your EAD. Yes you could utilize that EAD after your studies too. And at any given point of time one can have only one Staus. So in your case its either EAD or F1. If someone's EAD is already approved, I dont think that someone could change to F1 unless his/her EAD has been denied.


PS: I am not a lawyer. This is just my openion.
