My H1B expires in July 2010 so I would have to start the PERM process now. In this current economic downturn it seems that it will be extremely difficult to get PERM certified. I also have a Permanent Residence to Canada. My current US employer would be willing to let me go to Canada for 1 year (and work for him remotely) so my H1B clock resets and then reapply for a fresh 6 years of H1B after I came back.

What would be your advice: go to Canada and wait 1 year and then come back on H1B and apply for GC once things get better or risk it now and start PERM in this time? Please note that I live in New York City so it is even harder to get PERM as there are so many people here. I would like to apply in EB2 category.

Please advise.

If I were you...I would start the PERM now and if anything goes wrong, I would go to canada and come back after a year. If I get the PERM approved, I dont have to lose anything.

You never know. When you have back up why you worry.

pmamp02-27 07:29 PMI have I-140 filed and waiting for visa numbers to be current my PD is March 05 and Her name is given in I-140.
Since she will exhaust all her H1B years by end of this sept, he needs to be on either h4 or F1.

I have long wait for filing I-485, can she be on F1 in the meantime and then convert on H4 right before I could file for AOS?

Robert Kumar02-25 12:04 PMThe moment your H-1 is rejected and you dont have another underlying petition, you are technically out of status. You could apply for another H, but with a Consular Processing request. In other words you will be asked to leave the country and get a stamping before you start work again.

And not to affect your long term stay in the country, it is better to leave the country immediately.

One of my friends case was pending for more than 6 months with USCIS for H1B renewal, masters, and working at a client place. The employer checked with USCIS and they give a message " that the case needs further investigation".
What does this mean.

I am not saying you shouldnt look into other options, but this doesnt sound rosy to me.

Belgians enjoy one of the best quality of life in the world, job security, social security and free healthcare for life. Jobs are plenty and EU is a big job market specially when you can pick up some basic language skills (French or Dutch).

Belgium and EU countries in general have good labor laws which protect an employee. Its not easy for a European employee to be fired as in the US. I remember a French guy who worked in my office back in 2002 and was fired because of cost-cutting. His 10 year stint with the company brought him 50,000 Euros in settlemet (That's about 7-10% of salary for each year he worked for the company). The best part was he ended up in a new job within a month.

Unlike US you are certain to become a "permanent resident" after 5 years of stay on a work permit which in turn provides lot more opportunities in the long run. Not a bad option to consider specially when you compromise a little on the pay.

I talked to one lawyer and he is going to charge me 3500 for WOM. He has pretty good success rate. I am reading forum where they say it is better to wait minimum 2 years. Has anyone heared any case where wom is filed after one year and it was successful. My priority date is current.

Are you doing a COS from H4 to F-1 or is your spouse going to India and getting F-1 stamped directly?

Question:
If one applied for a new F-1 at the consulate and for whatever reason F-1 is denied, can she return back on H-4 visa that's already stamped.?

The F-1 at the consulate - you get to know immediately rather than wait in limbo for H4 to F-1 COS.

And if H4 to F-1 COS get approved in the middle of a semester when one is taking less then full time load, what happens?

Very Very Soft LUD = when 1 case before you and 1 after you.. is touched (Soft LUD) not necessarily consecutive cases :D

I am trying to draft a letter that specifically addresses the above 2 concerns in the PACE bill. Not including current PhD graduates in it will delay any potential benefits from this part of the bill on retrogression by 5-8 years, which is when new PhD graduates joining on F4 will graduate (the current PhD candidates will otherwise use up EB1 and EB2 numbers through their employers.)

Excluding life sciences again would reduce the benefit on retrogression by ~60% than otherwise, bcos > 60% international PhD students (may be closer to 80%) are in the biological sciences (most students in other fields try to do a Masters and then look for a job.)

I would welcome if IV could publicize this aspect of the PACE bill and the need to amend it.

If the EAD reneval is applied and If it gets expired before we get the new EAD, can I work by having the EAD reneval receipt notice with out affecting the employment.

No worries I also e-filed on july 02dn 2008. received paper receipts on july 11th 2008.

after waiting for almost a month or more finally received my FP appointment schedule on august 08th 2008 and on the same day received CRIS e-mail for RFE. FP notification was sent by MSC (National benefits Centre).

I guess their is some miscommunication between MSC and NSC...looks like the adjudicators started processsing the apps, but couldnt find the finger prints in their system.

Once I receive the RFE in hand i would know what information USCIS is requesting and from which service centre issued RFE.

I went for e-file just to make sure that USCIS doesnt loose the forms in their huge backlog of applications, but apparently Paper file ead renewals are working much faster than e-filed EAD. Its USCIS everything is possible in their processing logic.

Bottomline guys go for Paper based EAD renewals rather than this crap e-file, where the application are routed to different Service centres and nobody knows whats going on with their applications for months.

Read the lines.

Prereqs:
1. I-485 applied for EB-2 India
2. PD after Jun 1st 2006 (i.e. ,PD is not current)
3. There was an LUD on 07/27
Only then, reply to the thread!!

SunnySurya with date after PD Jun 1st 2006 replied yes, which means this update has nothing to do with the PD being current.

I have PD of Nov 2006, 140-Approved, 485-July 2nd. I have not got any LUD on any of my applications. So, this soft LUD might not be for everybody.

You raise a good point though when you said you assume i got h1 approved with i-94 attahced. This brings me to a scenario that just happened a few months back. I applied for extension h1b and h4 and we received notification that it has been approved and the approval sent to the attorney. But the attorney has disappeared. My wifes h4 approval was returned back to uscis and mine is not known where it is. we called uscis and they said we have to apply a duplicate i-824 individually to get the approval sent back to us again. i have therefore submitted i-824 application for my wife already. and i am submitting mine this week. all we have right now is h4 receipt for my wife and a copy of the approval for h1b for me (without i-94) that usually goes to the peititoner. What do you think about this?



Maverick_200804-16 09:14 AMFriends, my EAD/AP will expire later this year along with my 8th year H-1B extension. My 140 isn't approved yet. Now, what happens if my employer wants to cut costs and says let's extend only your H-1B for now and let your EAD/AP expire? If I'm not wrong, filing for H-1B/H4 extension is cheaper than that for EAD/AP.

Specifically, these are my questions:

1. Can I extend EAD/AP on my own?
2. If I let my EAD/AP expire and continue working on H-1B, can I reinstate them (EAD and AP) at a later date in the future once my 140 is approved? In this scenario, there will be a gap between two successive EAD/APs.
