I was watching FOX News this afternoon around 3:00 pm EST and they talked about a Polish Lady sueing the USCIS. Her lawyer was on the show and he talked about the issue. The host then talked to a Congress man (i think it was Tom Lombardo and he said that the US is bringing in a way too many immigrants and the US should stop it for a few years). When asked if the woman was wronged he rephrased the word wrong by "was caused inconvenience". Anyways, the lady's lawyer hit the nail on the head. When asked if she was sueing to get a green card. Her lawyer said no. He said his client was sueing for financial damages and also for allowing her to submit her application as submitting the application has benefits.

VisaHelp07-26 01:51 AMOkay, I applied for an H1 transfer late June 2006 on my own. Started at new job after receipt. Late August went on maternity leave. Came back to work in December. During maternity leave, my application was sent back due to wrong fee and no LCA (I didn't use a lawyer and was given somewhat bad advice.) By the time I did a re-application for transfer it was April 2007 (with the help of lawyers, this time). My H1 expired (6 years) near the end of June. But I was told I was okay as long as I was pending. Mid-July got a request for evidence with a date of September 20th being the latest date I can send in the evidence...pay stubs, tax returns, etc.

1. Am I currently out of status or okay because of the RFE?
2. If I apply for F-1 status now (thinking of a second Masters or PhD) will I need to send in the evidence for the H1B before that or will that not matter? It will take me a while to get all of the evidence, but I don't have time to wait in regards to getting the F-1 for school this Fall.

My lawyers suggested leaving the country, but I am fearful of that? Any suggestions, answers, advice?

EndlessWait07-31 05:02 PMThis is just a letter sized paper. No pictures. Some people accept it. Some don't. Even in Florida. It didn't use to have a signature. But I guess now it does. Last time I asked them and they said it is valid and should be accepted anywhere in FL. But, try renting a car with it.

Its worse if you have to travel out of state, and rent a car. I had to travel on work and it was horrible. Every time you use your credit card they ask for photo ID.
There is another thing called ID card, different then license.

You can apply for student Loan as a citizen if you use this clause intelligently. This is how most students get credit cards. If you say you are on H1 to a credit card company they will never give you the card.

Again this is only my opinion. I might be wrong.:)

not citizen but resident and that does not qualify you permanent resident.

and most companies require a GC holder or citizen to cosponsor.

485Mbe400110-08 12:54 PMSS tax has a cut off after a certain income level. The current SS is supporting the baby boomers and it is projected that in its current state by 2017 the current SS deductions will be less that the outflow. SS is marching towards a disaster.

PF is put in our own account, you get back what you put in along with interest. My company in india used to give a 100% deduction match, most s/w companies do the same. The amount that is put in PF will never go down as the interest rates are set by the government (inflation is a different story). IMO it is much better than social security.

There is no totalization agreement between US and India, its one of the reasons we will never see our SS contributions unless we work for 10 odd years or get that damn GC. This law is for employees from indian companies who used to come to work on short term projects.

Isn't this exactly what we have to go thru here in US by paying SS Tax?

1 . After getting Divorce in USA do we need to update the INS(is it Mandatory) to take away the wife from my Green card Process?
2. Planning to get remarried in India , while sending my new wife for H4 stamping , Is divorce doc alone is sufficient and if do not update the INS on my divorce , while my new wife goes to H4 stamping will that take care of evrything?

It is necessary to update USCIS on your divorce so that you can add your new wife to the GC process.

a) How much in advance we can submit HIB petition. I read some where H1B can be applied six month in advance.
Ans: What you read is true.

b) If we apply six month in advance, can those dates be from Sep 08, 2009 or the date of submission.
Ans: It would be from the date they officially received your application.

c) Can we include the dates for some one is physically not present in US
Not sure what you are trying to say here???!!!!

d) What supporting documents are needed to prove that some one was not present in US?
By showing no supporting documents, I guess And why do you want to do that?

all my expereince letter proir to 2002 ( I came US in 1999) and By the time I worked with two companys.

Now I got one company exp letter and other one closed and I couldn't able to get the letter. as per sources and attorney advice I am submitting coleague affidavit.

and also they asked me all w2's where I worked only few months in 2004 and w2 amount is not that great.

I am still fearing how do USCIS take in to consideration when they finalise the case.

Do you think all these are substantiate my case , or they may come with another RFE or denial..

Please advise me what I want to do, I haven't submitt my case yet.
