I got following RFE.

My original birth certificate doesnot show the name of my mother as local laws in my country don't put mother's name on birth certificate.

My questions:
1. How should I answer RFE ?
2. Who should sign Affidavits ? My parents, grand parents , relatives etc ?
3. Can anyone send me format of Affidavit please

I will appreciate your help.

A photocopy of a birth certificate issued by the Local Registrar if the person named above was born in a

city, or

A photocopy of a birth certificate issued by the Additional Disctrict Registrar's Office if the person

named above was born in a village.

If a birth certificate doesnot list the names of both mother and father, or the child, secondary evidence

must be submitted to establish parentage. Secondary evidence includes , but is not limited to , copies of:

medical recors, government-issued identity cards, religious records and/or affidavist from atleast two

persons alive at the time of birth. The oldest available evidence thats lists the names of both parents

should be submitted.

I think the labor certification is slowing going back to 2 years approval time including PWD. 3-6 months for PWD and 1 year to 2.5 years for Labor.

My lawyer ('s assistant) told me yesterday that the PWD's are taking 6 to 8 weeks to come back. 8 weeks have past now, didnt really want to force the issue though as it's not just me that's waiting.

i have until July 1012... Hopefully enough time for my PERM approval...

"Adjustment applicant who filed for the adjustment under the fee structure implemented July 30, 2007"

Note that it is not whether you filed on or after July 30, 2007 but the fee that you paid for I-485. I don't know why people don't even read the basic instructions coming along with the applications form!

Simply, this is the rule. If you have paid higher fee for I-485 then you don't pay fee for EAD (new or renewal). otherwise you must pay the fee. . As most of the people who filed before Aug 17, 2007 would have paid previous lower fee and those who applied know very well that they applied in August as part of the 'faisco'; it was basically a July 2007 filing with older fee.

Many lawyers don't know anything other than making money.

Thanks for the kind response. I am still using the same lawyer as before when I was doing my H1B and OPT. In fact, I do have a proof at some point, they asked for my I-20s. But when they asked them, they said that they dont have it. I am so angry - I am not sure whether it is to the situation or to them. I will NOT recommend them to anybody.
But it's kind of odd because I always have all my I-20s and other documentations in my emergency briefcase. While the other documentations are still there, only my I-20s (I have 4 or 5 of them) are all gone. So it is not simply I dropped them somewhere. It's gotta be I take them out for some reasons and perhaps never return them back to the briefcase. And to be frank, I feel that the attorney might have the original copy.

Do you have any idea to provoke the attorney to look for the copies? I resent the email they sent me 2 years ago when they asked for my I-20s copies. And today the secretary still said that she does not have the copies. The attorney does not respond to me altogether.

What made USCIS think that your educational background is not Computer Science? any idea.

I did B.E in Computer Science Engg, 4 yrs Course.

I have no idea why USCIS gave that reason. Actually, my company's attorney told that "USCIS denied H1B, because i don't have Computers background and am working as a Programmer Analyst".

That's all i know at this moment. I don't know whom to trust at this point.

You cannot be in H-4 status and work, even with an EAD. Either you have H-4 status and don't work, or you work on the EAD. H-4 status does not allow for work, even with an EAD. If the employer won't extend your H-1B, you just ned to make sure that you always have a valid EAD and an Advance parole so you can travel.
