Is it possible to file AC21 in this scenario. The salary and the job descriptions for both the Labor filing and the new opportunity are similar. I am worried if the title might cause a problem. I have to make a decision very soon. Please help.

chrisj04-03 07:17 PMI ran into similar circumstances in 2008 and i accepted some amount on 1099. So far nothing has happened. At that time money was more important for me than anything else. It was just one instance in my 5 years on H1. Right now i applied for I-140 and waiting for approval. I maintained my H1 status pretty good all the time. If there is ever an enquiry i'm thinking of explaining the proper reason why i accepted the payment on 1099. Hopefully there shouldn't be any problem.
To sum it up, It is illegal to accept payments on 1099 when you are on H1. And i would advice everyone to stay away from 1099. Every case is different and you never know what is going to happen

apb03-16 12:05 PMIf your boyfriend has degree+exp in engg, medicine, nursing, management, etc. he can get H1 from company that plans to hire him. Pl search for jobs on yahoo, dice, etc first. Not many companies would be ready to do H1 in present scenario.

My wife's company has filed for her H1B and she has been given the receipt number from her HR dept, but we are unable to check the case status online. whenver wetry to check the status of her case online it says

"Your case can not be found at this time in Case Status Online. Please check your receipt number and try again. If you need further assistance please call the National Customer Service Center at 1.800.375.5283"

i called up USCIS and they tell me that there is a technical problem and not all case status can be checked online ,they cannot give me any information on the status of the case and the rep said they can convey any info only to the HR dept of her company

However the rep confirmed that the receipt number is valid,

Has anyone had a similar issue? Not sure how i can go about this,

when my wife contacted her company's HR department says that they will keep her posted on any developments in her case

My wife came to USA on H4 and recentlly moved to H1.... We are planning to get her visa stamped...now my Q is same class of Vsia means any H visa like H1,H4 falls under H class of Visa...

OR

they refering to H1 visa as one class and H4 visas under another class??

If you have waited like me for 6 years to get your Labor Certified, then be prepared to wait another 6 years for 140, even if your PD is current and watch others who filed 5 years after you get their GCs.

I urge IV to raise one issue at the DC Rally. Please please ask Mr. Chertoff to do away with this farce called "Priority Date". It is an useless concept and should be done away with immediately. Everyone knows that the GC process is totally random, so why have something known as a "Priority Date" when it is anything but a Priority Date.
