My wife's H1B petition was approved in June 2008 with H1B valid from Oct 01, 2008. She applied for SSN on October Ist - But till date, Nov 18, 2008, SSN office is saying they are not able to pull her information from INS.

SSN office is keep saying come back after Dec 31st(12 weeks from October Ist). On the other hand, employer wants her to start working asap; she can't start until she gets a SSN.

Any suggestions, if there is anyway to follow up or expedite the process to get SSN?

So even if I apply for L1 extn, I dont know which might get approved first !! .
does that change anything ?

Nothing would change. If any, it'd be for better I guess.

So you dont know what the "last" action would be. If your L1 extension gets approved immediately with premium processing and H1 approval comes later with COS, then you dont have to go out.

If the situation is reversed, then it would be 1st or 3rd scenario, since 2nd scenario is not applicable.

I think that I485 at NSC is a typo. It is because they show that they issued all receipts for I140 and I131 received on or before 7/1, which was Sunday, and the I 485 show 7/1107, which should probably be 7/1/07, just like I140s and I131s.......guys don't panic..we'll get the receipts next week.

Dhundhun07-16 04:03 AMUSCIS decided a date Jun 1, 2006 to be current for EB2, so that Visa Numbers are not lost this year. This they decided on the basis of numbers of applications they were able to process by Jul 8, 2008. We all know that I485 Processing Date for NSC was Jul 28, 2007 and TSC was July 17, 2007. These dates were posted on Jun 15 and by July 8, might have moved by a day or two.

Last year USCIS announced (I remember it was last quarter) that for processing all the files received will take around 18 months. We have just 6-9 months gone.

Jul - Sep, the Priority date should not change, because USCIS has to approve all the processed application, they think approvable.

In Oct, also it may remain same, but after that, it will not be able to sustain demand and face retrogression. Nov 2008 to Jun 2009 there may be seesaw of Priority Date +/-1 years of 2005.

Jul-Aug 2009 USCIS may come across similar situation as this year - but in this case all applications of July 2007 processed - I think that time PD will be some date in 2005.

Right now Processing date might be frozen of 2-3 months, because USCIS may put entire energy in approving EB2 processed cases.

A good article supporting a sensible plan.

One minor correction however.

The figure quoted as 1.6 billion actually comes out to 16 Billion dollars if you do the math explained.

Milind12307-27 12:31 PMInstead of starting a new thread. I would appreciate if someone answers a few questions regarding Check details that we send out to USCIS.

Went to lawyers office last week and signed all the applications. I made out onc check in the amount of $745 ($395 I-485 + $170 I-131 (AP) + $180 I-765 (EAD)) Payble to U.S Citizenship and Immigration Service. Now when I see the forms online it says the checks should be payable to Department of Homeland Security. Should I ask the lawyer to hold on to the application and send new checks.

Also , should I write three separate checks for $395 $170 $180. Just to make sure if there is an error in say Advanced payroll application, USCIS will keep the two check and send me back the Advanced Parol application.

OK so today I went out with my father to take some images in the countyside, got home, looked on the PC, and there is dust spots in the image!

So I took a few more images of the sky (this seems to show up easily) and its still there.

I took my lens off, and had a look in and there is loads off dust, I tried using little brush to get some off the dirt off, but its still there.

I feel stupid about this, but, where is the sensor ? I can only see 2 mirrors, one I believe is the focus mirror.

I found another mirror behind another mirror and believe its the sensor but unsure.

I read that cleaning the mirrors has nothing to do with the output off the final image.

As you can see, there is a dust spot in the upper top half off the picture.

Could anybody recommend any cleaning solutions for this, I really need my sensor clean by Saturday as the start of the Isle of Man TT practice is here :)

I said how long should one wait...I opened an SR I got a reply that they are doing additional review contact after 6 months..3 days later I get approval email...no one has a clue...the right hand does not know what the left is doing....my wife is kicking me on the foot asking in native language be happy with yours do u want to loose urs too...

Me: Well I guess that's it I didn;t know anything after driving 60 miles that I didn't know before...

On the way back got a mail from my attorney...he checked thru AILA and talked withan IO ...it seems her biometrics need to be redone...it is ordered and she shld get it in 2 weeks she will be current next month too...so keep fingers crossed...well my fingers are crooked and can't be straightened now...

You do not need Biometrics uploaded for approval. My case was approved without it however they will only send cards after Biometrics are updated.

2. Is I-140 approval copy required? Interview letter does not say anything about it.

3. My attorney is not coming since he is too far from my place. Can I take any local attorney? Does it require applying G-28 again?

BEC_fog04-23 10:55 AMYes, that means your I-140 is "filed" under EB2...But note that USCIS can always comeback & say it "can" or "can not" be approved under Eb2 based on the job description in Labor.

In rare scenarios, USCIS comes back with a "NO" to Eb2, especially if the JOB description in Labor does not suit an Eb2 requirement. But in 99% of the cases, its fine (because, attorneys normally don't file it under Eb2 if its not one).

I read this on immigration-law.com which says that USCIS lost a lawsuit about its ability to look into the employer's requirement for job.

* In the labor certification based immigration proceedings, there are two federal agencies involved: One is the Department of Labor and the other is Department of Homeland Security USCIS. The immigration statutes give the jurisdiction of the U.S. labor market test government function over to the U.S. Department of Labor and one of the key elements of the labor market test is the description and requirement of jobs and prevailing wage in the intended area of employment. Accordingly, when it comes to the issue of the employer's requirement for job, it has remained the jurisdiction of the USDOL. However, sometimes, the USCIS, in adjudicating I-140 immigrant petitions, tends to overstep into the issues which clearly fall under the jurisdiction of its sister agency, DOL.
* Well, this jurisdictional issue was brought to the U.S. Court of Appeals in the 7th Circuit in Hossier Cares, Inc. v. Chertoff , Case #06-3652 (7th Cir, April 11, 2007) [Click "Opinion" to Download], which ruled that when it comes to the employer's job requirement issues, it is clearly the jurisdiction of the DOL and the USCIS should have no business to mess up with the issue. Isn't it something?!? The court says to the USCIS that you mind your own business with the issue of whether alien beneficiary is qualified for the job and stay out of the business of the employer's needs. Hoorah!

ras05-24 12:15 PMMy attorney told me that EAD to H1 will not counted against the cap if the person was on H1 before going on EAD. Is it true.

couple of attorneys with whom I enquired also told me that if you still have time on h1 then you are not counted under the cap and do not need to file afresh which goes through the process of lottery etc. I think at the most you need to go to the consulate to get the visa stamping. Can some one experience corroborate this.

Has anyone in the forum did EAD to H1?
