I've been working full-time on EAD for the last 2+ years. I have a pending 485 application, on which my spouse is the primary applicant. I have never applied for H1B in the past, because I transferred directly from F1 (student visa) to this EAD.

My spouse also has an H1B, which is in it's 7th year (completed 6 yrs of H1B).

My spouse has been put on furlough (unpaid leave) for 3 months.
What are our options ?

1. Can my employer file H1B for me, and an H4 for my spouse ? How will this affect our green card application (on which my spouse is primary applicant) ?

2. How much time does my spouse have to look for another job (with similar job description), without being out of status ? Is there some grace period associated with H1?

seahawks04-28 02:42 AMdepends on state law, WA state does not consider H4 as a resident, just found out a month ago, when my wife finished all the tests and everything else and found she had to pay non resident tuition. So she decided not to go to school. CA considers H4 as a resident provided all other criteria are met.

We moved just across the street from the original location and thus the company did not call USCIS to notify them of the address change because we still had access to our old mail box. Unfortuanately my approval notice was returned back as undeliverable and I received an email to that regard.

The secretary from office called USCIS and had the address changed immediately, its already been a month but we still haven't received the approval notice at the new address...has any one else here has similar experience...how long do you think we should wait before we call the USCIS again ?

I have I-140 approved(ABC company) and have 5 months left in my first 6 year cycle. I was laid off from the job. A New employer XYZ applied for my H1B extension based on I-140 approval and got approved for 3 years.But I was unable to join
XYZ due to family situation and moved back to India.

Questions:

1. Can a new employer apply for H1B extension based on my I-140 approval even though I am not in USA.? My I-140 has not been revoked or cancelled.

or

2.Can I claim the remaining time on my H1B approval(based on I-140) with company XYZ ?I have copy of the H1B approval but not sure if it has been revoked.

Please advice.

kopra06-05 10:51 AMYes, your current & past paystubs(Primary H1B holder) are needed to grant H4 Visa for spouse. H4 is a dependent visa and is granted based on the primary H1B visa holder's status. In case of transfer from H1B to H4, his paystubs are also needed to proove that he was in legal status during this time.

Hi friends,

If I apply for my husband's H4, do we need to show my past paystubs?

Or will my husband's H1 information, like his employment verification, I-94, and H1B approval be enough?
