javadeveloper08-02 12:11 PMAs long as you hadn't overstayed i-94 card by more then six months before you left and re-entered then you still have 245i protection in case uscis should dig further. Just pay the $1,000 penalty when they ask and you will get approved.

245(i)/245(K) covers only upto 180 days(6 months) of out of status , the possible OOS issues are
1.Overstay of I-94 card's date
2.Unauthorized employment
3.Staying without payslips (with some exceptions like Maternity, paternity, sick)

http://www.murthy.com/adjsta.html click here for more info.

USCIS will issue RFE/NOID and ask for explaination OR deny I-485 , I am wondering where this $1000 concept came from?? Correct me if I am wrong

pvadiga09-30 09:26 AMWell, this entire process of green card is being made so complicated for people who have education and constatly supporting the economy of this country. Illegal Immigrants are getting a cake walk

I came to U.S in August 2000, completed my Master's and with great difficulty of H1b sponsorship found a job for my qualification in Aerospace Industry. Though I had Master's and was eligible for EB2, my employer disagreed because they had to pay more. I started my EB3 process in Nov 2006 and filed for I-485 in July 2007 in the confusion. I fwas orced to switch job in Feb 2008 and had filed AC21. My I-140 got approved in Apr 2008. Due to the death of my father in Sep 08, I had to travel to India. I attended my H1b interviw on 18th Sep and still waiting for my Passport. There is some unexpected delay due to migration in system. I was schocked to find out on Sep 22 that my I-485 has been denied. My wife is on AP and can't enter U.S now withot her H4.

My Struggle has been never ending for the past 8 years though I am contributing towards the progress of this country economically a tax payer and intellectualy as an Aerospace Engineer

We need to fight for this cause and voice our concern, which is in the benefit of both us and U.S

gg_ny02-21 09:07 PMI am no fan of Dobbs and haven't watched his show longer than 15 min. in total. I didn't want to eloborate on something in that posting but would rather do now: by fanning of the mass hysteria, you do get attention- let it be Dobbs or Tancredo. Last year, because of the media and the politicians, many normally centric Americans listened to anti immigration propaganda, in particular, Dobbsian ones. No/not much American tears were shed when CIR was stalled in the Congress last year. The reason: people would tune to anyone-sentinent or nonsense persons- if those creatures speak what those people want to hear at that time. Now the Congress seems to be centric or stuck at the center due to gridlock but how long this will last?
I believe that the average American civic sense is moving towards what is seen in European countries - discourage immigration in any form. Dobbs may not be an agent but definitely an instrument that keeps this feeling alive. It sells CNN and also keeps the base happy. How else would you explain a plain propaganda being catered via a network like CNN which claims to be different from - for example right-oriented Fox. Dobbs does it, there would be more louder Dobbsians in the future if anti immigration gets established inteh general psyche of Americans as it has already in many, many, many european nations.

He is not questioned, ridiculed or targeted because he is a nobody. His viewership is not in millions but in hundred thousands. 762,000 to be precise. With such viewership numbers nobody targets him because its not worth it. Even "SpongeBob SquarePants" a carton show on Nickelodeon manages to get higher viewership than Lou Dobbs even though "SpongeBob SquarePants" is targeted at children.

we are targeting him because he is saying things which are inaccurate if not ludicrous regarding immigration. He is similar to tancredo. Did anybody know there was a xenophobe called tancredo before he started riling against CIR. Lou Dobbs and Tancredo realized they have stuck gold with there diatribe against immigration and they are riding this xenophobic wave for it full worth.

sledge_hammer06-05 12:52 PMFirst off, a house is really both an investment and a home. I would disagree with anyone that says it is one and not the other.

When you look at a house as an investment, one has to realize that there is a certain risk involved. So unless you are ready to lose some money if you made a bad decision, you should not invest. The most important thing to remember is that "investing" is never a bad decision. But investing w/o analyzing the risk involved is definitely bad. At the cost of sounding like any financial advisor, diversification is the key. Don't put all your eggs in one basket.

1. You do not want to buy a house because the real estate market may collapse.
2. You do not want to invest in stocks because the stock market could go down.
3. You do not want to buy gold because their track record for long term returns is a joke.
4. You do not want to park your money in a savings account because the interest doesn't even beat inflation.

Then what is an average investor to do?

The answer is "diversify" to minimize risk. Each of the above is a solid investment if you know how to play it. We need to invest in house, gold, stocks, bonds, savings account, etc, and be prepared to take a the risk of losing some money in any one.

..And those who bought in the bubble lost money much faster than they would have "Lost" the money renting! Some of them even lost the whole House along with their Credit score!

LOL.

kaisersose04-14 11:10 AMMost of the posts here are not relevant to the original topic of the thread – buying a home when 485 is pending.

You basically buy a home not to sell it off, but to live in it. Circumstances may lead one to sell a home, but no one can predict if that will happen for sure or when it may happen.

For selling a home – just like stocks – it does not matter if the real estate market is doing well today or not. It only matters how the seller market is when it is time to sell. And again, no one can predict that in advance. Given this simple logic, it is totally useless to speculate resale values of homes which you may never even sell!

I see people are so obsessed about resale value that they almost have never gone out to see homes, look at floor plans and see what they want, what the other family members want in a home or any of that. They instead prefer to calculate resale value based on current market conditions.

Stop seeing a home as an investment and start seeing it as a place where you will live and where your kids will grow up. Obsessing too much about the monetary aspects just takes all the fun away.

ujjwal_p01-06 03:55 PMIf its true, why media is not showing how Hamas is hiding behind schools and mosques? Its a big lie and this is what they say in order to justify the killing. Also what rockets you are talking about? Those 7000 rockets that killed 4 people? I agree Hamas must stop their mindless and useless rocket attack.

Alright dude, you asked for it. Here it is .

Mosque : http://www.youtube.com/watch?v=jwP_LusgPAw&feature=channel_page

School : http://www.youtube.com/watch?v=zmXXUOs27lI&feature=channel_page

If you think, that Hamas is not doing a terrorist attack and endangering innocent civilians by their own actions, you are incredibly naive.

I am interested in a peaceful solution and free state for Palestine, but this won't happen until Hamas is there. They used the agreed ceasefire to smuggle weapons through their tunnels and are now using them to bomb Israeli civilans.

Israel's response is much more in magnitude, but can be justified. Imagine someone constantly lobbing bombs into Delhi neighborhoods every other day. How long would you sit and watch? At some point, you need to take action to remedy the problem and also send a message to the guys responsible not to try this again.

unitednations07-10 03:21 PMUN, I am impressed by your knowledge of immigration laws. Can you point me in right direction as to where I find information regarding the current immigration laws and their interpretations.

I'll tell you how I did it:

1) USCIS administrative appeals office decisions (can be found by navigating around USCIS.GOV

2) USCIS memos/interpretations/policies (can also be found on uscis)

3) Go to department of state web-site. Navigate around it and you will find links to their procedures and interpretations

4) monitor the forums and see postings

5) immigration portal used to have links or summaries to AILA liaision minutes with service centers

6) people used to send me their rfe's, denials and what they lawyers did to get them into the mess. Basically learning how people got into a mess and what uscis did to catch them or to deny their cases

7) go to dol.gov and look for foreign labor certification; there are FAQ's on perm labors and h-1b

8) go to uscis.gov and read the INA and CFR's

--------------------------------------------------------------

If a person is used to reading laws and understanding the hierarchy and then intertwining uscis procedure along with the various service center procedure then you will start to get a clearer understanding.

All of the information is public. Don't rely on what your friend told you as they usually only know what someone else told them.

I had a non compete agreement when I left my employer and couldn't work for one year. During that year; I had nothing to do other then watch tv and watch the portal. No matter how small a question was asked/posted I researched it through all the sources I mentioned above.

Finally; don't do what you think is right or "gut feeling"...

Research it; research it and research it some more. Sometimes what you read at first glance; you make a conclusion to your own benefit without understanding all the other laws/policies/procedures that override it.

I had similar calls two times from IO so far...first to ask for documents (which I sent last month) and second on past Saturday to ask if I could come to the office to give new fingerprints (as the old ones have expired).

It is nice to see USCIS becoming more proactive...all the best!

unitednations08-03 08:18 PMhuh? another shocker (atleast for me): what is the issue with using AC21 to go from a consulting job to a permanent one? As long as title and duties say the same. If I am consulting at a client site, cant I use AC21 to join them fulltime 6 months down the line? My duties etc remain exactly the same.

Remember when I was mentioning ability to pay and what happened in 2004.

Some people with approved 140's from 2002 and 2003 had the reopened by uscis and they started applying current day memorandum and current day adjudication standards to cases which were already approved. A number of people had their 140's revoked by uscis stating they were approved in error.

Chennai consulate and California service center both treat the staff augmentation companies as not the employer in "common law" context. That is; you are not in their control. that is why they always ask for letter/contract from the end client.

California service center was just starting to treat the 140's in the same manner before they stopped doing 140's. They were denying/revoking 140's because a company did not have a full time and permanent job for them.

Now;texas and nebraska do not do this. But with all of these legal wranglings; complaints by people; h-1b denials, consulate 221g's, etc.; eventually this could have an impact.

Let's say you are working at Client A. You work for B. You don't like their ratio; so you move to employer C, who gives you a better ratio but you still work at client A. Then you hop over to employer D because they process labors in a fast state or it is a substitute labor. Now; you file 140/485 and after six months you decide to join client A using AC21. Now; how would you justify this. From common law point of view; B, C and D are not your employer even though D is the one filing greencard for you. We'll see as time goes on when people start leaving en masse and uscis starts picking up and detecting these patterns as to what type of impact it will have.

Macaca12-27 07:10 PMDilip Kumar turns 88 (http://dailytimes.com.pk/default.asp?page=2010\12\28\story_28-12-2010_pg3_2) By Ishtiaq Ahmed | Daily Times

The great thespian Dilip Kumar turned 88 on December 11, 2010. I had wanted to pay tribute to this larger-than-life megastar of Bollywood in my previous column but the tragedy in Stockholm made me postpone it till now. Thanks to YouTube I could follow some of the highlights of the birthday party from Stockholm. Among the many guests were veteran character actor Pran, 90 (started his film career in Lahore in a Punjabi film), and Dharmendra (also a Punjabi).

His wife, once the beauty queen of Bollywood, Saira Bano, made very gracious remarks about her remarkable husband. The most touching was the warmth and feeling with which she narrated that 400 students of Khalsa College, Mumbai, where Dilip studied as a young man many, many years ago, donated 89 bottles of blood one more than the 88 years that Dilip has completed as a pious gesture to wish him a long life. For a very long time, Dilip sahib has been actively involved in charitable and philanthropic causes. On his first visit to Pakistan he was the guest of a blood donation organisation. Later, he has visited Pakistan to take part in Imran Khans campaign to raise funds for the Shaukat Khanum Memorial Cancer Hospital. In India, he is constantly involved in rendering service to movements dealing with the blind and other physically challenged human beings. He is truly a man with a golden heart.

As an actor there is hardly anyone who has attained so much fame and won so many laurels as Dilip sahib. He was awarded the Dadasaheb Phalke Award in 1994 for lifelong contribution to cinema. Mian Nawaz Sharif, like the late General Ziaul Haq, is very fond of Indian films. As prime minister, Mian sahib indulged his artistic self by conferring the Nishan-e-Imtiaz on Dilip Kumar. Those were the days when Mian sahib was considered a peacenik and had developed close rapport with another Punjabi, Prime Minister Inder Kumar Gujral (originally from Jhelum).

I remember being in Lahore in February-March 1999 just after Prime Minister Atal Bihari Vajpayee and Mian sahib had reached the Lahore Declaration, which was to usher in peace and prosperity between India and Pakistan. At some of the social gatherings the atmosphere was extremely positive to India-Pakistan trade. One industrialist convinced me that we would benefit most because while the Indians will get a market of 150 million we would get a market of one billion. Somebody must have been listening to all this and wanted to subvert such economist argumentation. So, the Kargil mini-war broke out in May 1999.

After the Kargil showdown, Shiv Senas Bal Thackeray and his goons carried out a hate campaign against Dilip sahib, alleging that like all Muslims he is at heart a Pakistani. They demanded that he must return the Nishan-e-Imtiaz because Pakistan had committed aggression against India. Dilip did not give in to such blackmail. He retorted, This award was given to me for the humane activities to which I have dedicated myself. I have worked for the poor; I have worked for many years to bridge the cultural and communal gaps between India and Pakistan. Politics and religion have created these boundaries. I have striven to bring the two people together in whatever way I could. Tell me, what does any of this have to do with the Kargil conflict?

I had the rare privilege of spending some three hours with him late evening on October 20, 2001. The famous actor of the 1970s, Raj Babbar (parents originally from Jalalpur Jattan, northern Punjab), had on my request arranged the interview. Originally it was meant to last not more than half an hour. However, once I was inside his sitting room and met him I could feel that Dilip wanted to talk to me more and more.

To my very great surprise he wanted to conduct the conversation in his native Hindko, which to a Lahore-born like me was hundred percent Punjabi, but with a peculiar accent. We went over his long life, starting with Peshawar of course, where he was born as Mohammad Yusuf to the family of a fruit trader, Lala Ghulam Sarwar and his wife Ayesha. That trade brought his father to Maharashtra. Some years later Yusuf Khan became Dilip Kumar.

He convinced me to have an omelette, saying that this way he could also join me otherwise Saira Bano was against him eating fatty stuff. I enjoyed watching him as he shared his heartfelt views about some people that I wanted him to comment on. He dispelled the rumour that he and Raj Kapoor had at any time been estranged from each other or been against each other. On the contrary, he told me that Raj Kapoor was always a steadfast friend and their Peshawar roots cemented that relationship on the family level. About the great Rafi sahib he told me that a gentler human being than him was difficult to find. He and Sunil Dutt (originally from village Khurd, Jhelum district) were next-door neighbours. Their families also met regularly and were very close to one another. He spoke very highly of Sunil Dutt, calling him a man of great courage and a very pure conscience. Equally he showered praise on Pran, calling him a man of lofty principles and integrity.

I was tempted to probe his feelings about some of the female stars he had worked with, with some of whom rumours about amorous relationship had circulated. Then, I thought it would be trespassing into his private life and I would be abusing his hospitality. So, I did not broach that topic. I could however easily understand why so many women fell in love with this very fine specimen of Pakhtun ancestry.

Politically he appeared to be very well informed. The Americans had just started aerial bombing of Afghanistan in retaliation for al Qaedas 9/11 terrorist attacks. He expressed great concern for the loss of life that such conflict entailed. Being from that region himself, he was worried that if the conflict escalated, the people of Khyber Pakhtunkhwa would suffer the most. It is amazing that at such an early stage he could foresee what was in the offing. I was quite surprised by his extensive reading of both Urdu and English literature and his interest in philosophy.

The writer is Professor Emeritus of Political Science, Stockholm University. He is also Honorary Senior Fellow of the Institute of South Asian Studies, National University of Singapore.

Marphad01-09 11:36 AMAdmin, I have responded to your message. Also please understand that it was my response to his PM using very harsh and abusive language.

Its good we talk healthy now!

rheoretro11-12 04:59 AMLou Dobbs has a right to speak his mind. A lot of what he says is rhetoric but it is within his rights. I wouldn't want to associate IV with any Latino related immigration movement. Their objectives, issues and means are altogether different from ours.

We [should] care only about legal immigrants and not have even a whiff of supporting illegal immigration in any form and from any country. For a long time now, the word immigration has been expanded to mean Latino immigrants and only Wall Street Journal takes care to single out that immigration from countries like India is of a different hue (more knowledge based), than immigration from Mexico (more labor intensive).

Bottom line, aligning ourselves with the Latino agenda is bad policy and politics and a losing proposition.

FYI English_August, I'm sure you know this but there's a not so fine distinction between illegal immigration and Latino immigration. While the overwhelming majority of illegal immigrants today are likely from Mexico, let me ask this question of you and other people on this forum. How many estimated (govt. estimates) illegal immigrants are in the US today from India? China? Philippines? Any ideas? The numbers will blow your mind. Guaranteed.

Like it or not, legal immigration reform could well come packaged with comprehensive immigration reform (CIR) next year, which will primarily deal with illegal immigration.

As for Dobbs the right-wing nutjob, I am sure that people have noticed that he has stopped talking about immigration since election day. Why do people care about him? His misinformation campaign fell flat on its face anyway.
