ive sent out so many cd's with exes of director and flash on it - only to find out that most companies have firewalls that wont allow exe opening, or that the cd simply wont open on a mac.

Due to current retrogression, I want to explore the EB1 route. The question I have is can I apply for a new EB1/AOS in view of my current status of being in AOS/EAD already.

morchu06-10 06:12 PMYou dont have to be employed by the employer for 180 days. All you need is 485 pending for 180 days. So in the letter you can mention that 485 had been pending for more than 180 days.

The only catch is if USCIS question about your "intention" at the time of filing 485. (Since you didnt work for the company after 485, and now specifically says dont intent to..).

At the time of filing 485 you should have proper intention to join the original employer.
Maybe somebody else who went through similar experience can help u.



AC21 invocation letters typically state that you're using AC21 for switching employment after 180 days. What argument should be used to invoke AC21 in my case?

Not true. There is no limit, except that eventually US immigration may decide that the person has relinquished their permanent residence if they stay outside the US for many years.

Secondly, Is there any limit on number of times a Re-Entry Permit can be applied?

No, the first 2 are for 2 years each, and then one year at a time. Again, CIS will eventually question whether the applicants really intend to return here.

As soon as I return, I'm planning on beginning the process so that my future wife could come to the United States to live with me. We plan on getting married in the Catholic Church, but we have doubts if that type of marriage is a valid one for this specific situation. We just don't want a delay in the process simply because it was a religious marriage and we want to be with each other as soon as possible. My question is: Is a religious marriage valid for this situation? Which one would you recommend: Having a civil marriage or a religious marriage in Mexico?

I don't know about Mexico but, in India, most of the citizens have religious weddings and then, they register that with the Marriage Registrar's office to get a marriage certificate.

It appears that my lawyer may have missed sending separate copies of it for each application (485/765/131). Anyway I sent color copies of the passport pages as well as driver license. The status for the application changed to "Response to request for evidence received on 10/09/2007 and processing resumed".

As far as your FP notices, I have read that others have been able to get the notices after calling the Service Center customer service. You might want to consider that.

3. Not necessarily. At any time, whenever you file extension, the criteria is checked again. Means if the 140 is revoked after getting 3 year extension, then the next H1 filing will get rejected, since you don't have a pending 140 anymore. So the answer is, it depends on whether you have a pending/valid LC/140 at that time.

My 6 years on H1b expires on Nov 2010. I have 140 approved from company A.

I have an h1b stamped in passport that expires in july 2011. However, it is totally unused because i had to leave my company for higher studies in 2009. Now, i am joining the same company again in may 2011 after studies.
1.Is visa extension for 3 years possible in such case..?
2. Will there be any problem because of not using the visa at all till now..?
3. Is there a minimum time limit after joining aftre which only I can apply for extension..?
4. Most important, can i apply for extension even after expiry of visa in july,2011...??

I am currently out of USA.My new employer has submitted H1 Transfer and extension of stay.
The petition has been approved along with new I-94. I have the original I-797 with me .

I understand that we have to surrender I-94 before leaving USA.But in my case I got I-94 after I left USA.Now I need to go for visa stamping in India.

Should I submit the new I-94 to the US consulate in India?

Please advise.

So total L1 period is 13 months so far. and Total of l1+h1 is 6 years. so you can have 4 years + 9 months on H1 and your initial H1 will be for 3 years
