Recently I have received following mail from USCIS that my case is transferred to NBC. How it's going to effect my case process? What could be possible reason that it transferred to National Benefit Center? IS NBC faster or slow?

I'm single/no dependents but for past 4 yrs or so when filing taxes have showed 2 dependents for child tax credit (no earned income credit applied for)....my niece/nephew. My bro had full knowledge and he had suggested as due to his status in US, he is not required to file taxes. Sis in law not working, so not filing taxes. So i used to do that....

It won't come to bite me right???? ok i am never doing this from now on but is it too late for me. Obviously on my immigation forms i will show no dependents etc as i have none...

any advice.....


Personally, I wouldn't send my tax returns until I have spoken to a GOOD lawyer. There are quite a few IO that do not ask for tax returns b4 or during the interview. However, it shouldn't be a problem as you can explain it away. Simply - they were my dependents in those 4 years !! But now they are not, simple.

kaisersose04-16 04:42 PMRecently, one of my co-worker who was on L1A, requested an extension of his Visa. His employer filed for an L1B instead and did not inform him until after filing it. Now USCIS has sent an RFE. Does anyone know if this can be grounds for rejection of his Visa? Is the employer legally correct in filing a changed Visa category at will without informing the holder? His wife is unable to obtain a driver's license since the Visa approval is pending. Does anyone know if this can be addressed? If so, how?

What is the RFE?

The employer and/or the attorney may have determined the applicant did not qualify for L-1A.

gcpower101-07 02:00 PMMy friend with july-07 filer (I-140 approved in Jan-07) lost H1 in Mar-08 and work on EAD and his company move to new address in May-09. USCIS site visit on Aug-09 to old address for H1-b (one year ext) for his co-worker. His co-worker got letter form USCIS to submit documents in Dec-09 for existance of the Company. Company inform everyone in Nov-09 that it is going out of business and shutting down operation in Dec-09.

What are the options my friend and his co-worker with (LC/I-140 approved form another company) have??

roseball02-21 11:39 PMI know that PERM labor gets expired if one does not file I-140 within 180 days of labor's approval date.
I am wondering if DOL has any procedure to revive expired approved/unused PERM by filing some sort of request/appeal or by paying some sort of fees etc. or if not ,then one files a new PERM by referring the old unused approved labor for the same job and same person then DOL can give an expedited approval.

Short answer is NO.

You have to file a new PERM and it will be processed in the existing processing times unless its a special handling case (University profs, etc) which currently is taking around 4 months to get a PERM approval.
