My wife has H1 visa approved under Consular Processing from Company A, so she is still under H4. She got another offer from Company B so we applied for another H1B before H1B quota expired. It is under process.

1 ) we applied for COS from H4 to H1 By Company A by premium processing.

2 ) Company B H1B from H4 is also under process.

Does the order of outcome from either petetions affect another petetion. For example if companie A petetion is approved and then afterwards company B petetion is rejected. will she be in H1 status.

roseball07-11 12:57 PMDo note that AILF does cover people who were eligible to file in July but did not file due to USCIS/DOS revised bulletin.....However, it is unknown at this time what the outcome of the lawsuit would be for July applicants vs eligible but non-applicants as the decision is at the discretion of the Judge.....

IMHO, its better to file and get rejected......

was told that the case is in the examination section. He did not give me any details as he said thats all what he sees on the screen.

any one tell me what that means and how long could it before they will adjudicate?

STAmisha08-29 12:26 PMMy spouse is on H4 currently. Have applied for H1 in April 2007 and got the H1 aproved. So the new H1 starts on Oct 2007. However, we applied for 485 and got our EAD's (No recept number, No finger printing etc).

Can my spouse use EAD to start job? we dont want use that new H1 currently. What are the implications if we use EAD? Will the H1 (and my H1) be effected?

My PERM was recently approved and my company is getting ready to file the I-140. My attorney just noticed that my company at the time of registering the PERM account accidentally listed the FEIN number of their sister company (with similar name) rather than the FEIN number of the company that filed my PERM and on whose payroll I am for the last three years.

Do you think this would be a problem at the I-140 stage since the FEIN number on the PERM is different from the one on the Form I-140 and my paystubs/ W-2? My attorney is telling me that this should not be a problem as it is a typo and he can explain this to the US CIS at the time of filing the I-140 or maybe we can stay quite about it now and will explain it to the US CIS if they have any questions about it.

I will appreciate your response to this.

I am working on H1 and my current H1 petition is valid until April 6th 2011.
My visa (stamp) expired in Nov 2009.
I have my new H1 extension petition approved from April 7th 2011- 2014( same employer).
I am going to India early Feb and will going to Hyd/Chennai for visa stamp.
In the visa appointment it is asking for my petition number: which one should I give current or the new extension one. I would like to have my H1 stamped until 2014 so that I can avoid additional trip to consulate.
Please help.

hellomms02-12 12:06 PMThe ridiculous amount of time DOL is spending on the Perm Audits in just incomprehensible. They still approved 1 may be 2 application a day, thats my assumption. Last time I saw they are still processing audited-applications filed in Aug/Sept 2007.

Any word on how what their plan is? They really do have bunch inefficient people working for government!!!

I heard from friends that, you need to have valid passport for the entire period of H1B petition validity. Wondering, If am in trouble for not renewing my passport before it expired. Please give your opinions.
