My 6years of H1 expires on Apr'2011. Company A filed for perm, perm went to Audit, Got 7th year extension which expires Apr'2012
Later, moved to Company B, got Change of Employer approved until Apr'2012.
Now I am going to India and need to get stamping. Will I have any issues in getting the visa stamping for 7th year? Please advice.

Both Company A and B are very big companies and I am direct employee not a contractor.
I have the CompanyA's perm screenshot and email, but don't know what its status, as i left the company and I am not in touch with them

I have a seriously ill family member back home, and my husband and I have an understanding that if anything happens I'm getting on the plane no matter what. I'm just praying I get my AP soon so the "no matter what" doesn't have to mean abandoning our home and life here in the US.

sk.aggarwal01-16 03:32 AMI have filed for the 7nth year extension based on my pending labor (365 days old). The perm is picked up for an audit. Incase if the perm is denied, will h1b also be rejected ?

As per my understanding, your H1 will not be denied but you will not be eligible for any subsequent extensions unless at that time you have one more perm pending for over 1 yr or I-140 approved.

I would recommend you find another employer or file perm through some one else as future employee. 30% perms in audit are denied after 2 yrs wait.

Do you have EAD? If not, you may be in trouble as H1 does not allow you to do a side job.

1. Whether I can transfer my H1B (sponsored by company A) to company B when i join them? (but H1B is not stamped yet on PP) if not H1 transferrable, then I've to use EAD only.
2. Company B will ask me what papers I need for GC sponsorship either NOW or in FUTURE, can anybody know this? please help
3. I know that i need to file AC-21 to do the switch, what are the procedures like:
a. job position should be same or similar?
b. what paper work other than AC-21 needed to do this switch in changing employer information, fees for doing this change?

any help/advice would be greatly appreciated. Please let me know.
