garybanz03-27 10:13 AMAs a H1B holder, can I start a new company and volunteer for it while I am holding a full-time job for the company that sponsors me the visa? I am expecting the new company to gain a profit, of course.:)

Yes you can, start your company and volunteer for the company but not together :(

You can start your own company but can not work in it.

You can take a part time/ 2nd job by filing a 2nd H1 (the 2nd H1 will be in addition to your first H1), but you can't own that company!

Interestingly your wife can start a company and sponsor your 2nd H1 in her company ;)

Note: While nothing above is wrong or not allowed, some of the information above may have shades of grey...check with really good attorney before you take this up.

cs00710-31 12:35 AMHi, I am in 8th year of H1b with 140 approved (EB3) from company A. I would like to switch to company B and planning to start EB2 quickly to enage a new interesting project . I have following questions related to the same and early advice from you all would be highly appreciated as am running out of time in engaging the new project.

1. Can I do H1 transfer from company A to company B using A's 140 approval after my 6 years of original h1b quota. I am currently on 8th year of h1b.

2. Can I able to port the priority date from company A's EB3 filing with the new EB2 filing from company B?

3. If company A cancels the 140, still can I able to port the PD ?

thanks.
CS

MatsPFebruary 13th, 2009, 04:06 AMThis obviously depends on the reason it was refurbished, but I would expect that most refurb cameras are warranty returns that have been fixed of whatever the warranty problem was. Since the repair would replace the failed part, it would be fair to say that they are at least as good as the original one (and if it's a "common problem part" then it's even likely that a new, better part has replaced the faulty part, which would make it BETTER than the original one).

And obviously, with consideration for the reputation of the company, I would expect that Nikon doesn't sell refurbished cameras that have any notable faults (scrapes, scratches, dust, etc) - if the damage isn't in an easy to replace part, the camera is probably used for scrap parts for other repair projects, or just destroyed.

Of course, I would check what the terms and conditions for returns, refunds and warranty is - are you paying less because you get less warranty, or simply because it has 10 or 100 exposures on the "clock", or because you get less warranty or other rights to complain?
