green_454503-07 10:26 AMMy current title is Software engineer and my company is promoting me to Senior Software Engineer. I am on H1 and have filed I-485 in last July and also have approved I-140. This is just the title change and my duties will be same.

(1) Does my company need to file H1 amendment to keep me on H1 or do I have to necessarily switch to EAD?

(2) Does anything changes with respect to GC process?

(3) Do I need to have any specific paper work from the my company that job duties are same?

Any help is greatly appreciated.

Ask him to print the duplicate from your payroll system....this should not be an issue at all if he is not trying to hide anything.

There is a good chance that the visa officer will ask you to prove your legal status on H1 and you may have to do a lot of explaining about the change in status.
It just seems like something is not right here

I have worked in the US for 3 months (april, may and june) on H1b visa and still haven't got my pay stubs. Recently I came to India for my marriage and after marriage, I want to go to US on L2 visa (my fiance is on L1 visa). While trying to go to US on L2 visa, will I be asked to produce my previous pay stubs? Also when I asked my employer to give my pay stubs he said he had lost them and said instead of pay stubs I can have W2 which will be the proof that I have worked. Will the W2 be enough or I need the pay stubs? Please someone clarify my doubts.

Instead, they are liable from the start date they requested on the petition OR the day you are physically in US whichever is later.

In most cases employers request immediate start dates so that the employee can start working as soon as the petition is sent (portability).

I am applying 485 for me and my wife.My wife got H1 in Oct 2006 but she didnt work until now So she dont have any paystubs.So my attroney suggested to do it on H4 but her H1 is to be collapsed for that she is planning to go canada (not for stamping)and come back so that her H 1 will be collapsed and H4 will be there.I came to know from my friends that canada people are not givng any I 94 for visitors who travle by road.If we request for I 94 they are asking to keep the same I 94 which we have in our respective document.I just want to know how to get the new I 94 for her?
And also Please suggest If there is any way to apply for 485 without cancelling her H1.

However, note that when she goes for her H4 interview, she might be asked to prove her H1 status by showing her employment details (recent pay checks, tax documents..) in addition to your employment documents before they give her the H4 Visa...This happened with one of my friends at Chennai embassy...Just wanted to give you a heads up on that....

Once the AR-11 and G-28 forms are submitted, follow up in a couple of weeks by calling customer service to verify that your records has been updated with the correct address and attorney information. Also, if possible try retaining your previous attorney for your case, this is always a safe option.
