h1b-200703-31 07:55 PMI am planning to complain against my employer for not paying bench pay. He says he can prove that I never reported to him. I got my status changed from H4-H1B since October2008. He already got a signed leave letter from me . Now I would like to come back to legal status. When I make a complaint to DOL how can I prove that I worked for this employer. I never visited their office personally. All the communications happened through phone and email.
We had many e-mail communications between October to till-date. Is this enough to prove my case? How can he defend himself saying that I never reported to him. I am genuine candidate with real experience and never faked my resume. I am ready to face any legal issues. Please guide me how to proceed.

delhibaba07-24 11:46 PMMy new employer doesn't sponsors/transfers H1B visa. And my priority date is Dec 04 EB3 so I don't think that I would be getting my GC in near future!

As per the job I know this one is the safest since the new employer has never ever laid off employees in its entire history. So, I'm not worried about the job security, only thing which scares me is that if there is some problem in my I-485 and I get a denial whether I would be able to switch back to H1B?

Worst case scenario my wife has a valid H1B and I can switch to H4 and probably wind up the things here :-)

I had applied for 485 in July with Future Employer in EB3.
After 6 months, I want to port the application to my existing employer. At that time, is it possible to convert the application from EB3 to EB2 using AC21 portability??
Any help is appreciated!!!

My company changed address recently from address City A to address City B (same county, same metropolitan area). Do you know if I need to do any LCA Amendment?
I had consulted a lawyer regarding this, he said we don't need to do any LCA Amendment since it is the same metropolitan area.
Also I am not getting any clear answers from any other websites.

Wanted to cross check with you all. If anybody know please help.

Employer's lawyer is saying that i can continue to work since have valid I-94 and they are going to appeal. Lawyer called USCIS officers and USCIS officers confirmed this ( !!!).


Second lawyer is saying that i should stop working on denied petition.


Once you apply for appeal or motion your H1B peition status changed from 'Denied' to 'Pending' and you may continue to work for employer. - this is my guess

In fact, I am planning to get advice from murhty too...

Any thoughts on this.

If they pay you via a check to the company you own, then they will be paying for services rendered. They will not be paying employment taxes(SS+Medicare) on that check amount. You will end up paying Self employment taxes amounting to 15.2% on this amount instead of the 7.6% had it been part of your W2.

As far as the impact to the GC process. I dont think the excess amount should be a problem, but pls confirm with an imm.attorney

You can use RichTextBox for inlining hyperlinks. It is available in WPF and Silverlight 4 projects. Your hyperlink can even be a path to a file :)



gondalguru07-11 05:26 PMI have filed I-485 as derivative on my spouse case with his PD of EB3 Dec2005 as his I-140 was also approved in july 2007. I have AP/EAD through it, but have never used them.

I am currently on H1B and just got my I-140 approved through my employer in EB2. My priority is Feb 2005 which is much earlier than his EB3 Dec 2005. The approved I140 has the same Alien # that I received through my pending AOS case filed earlier in july 2007..

Do you recommend filing I-485 again based on August bulletin now that my PD is current.

How does processing date working in tandem with Priority Date.

What is your take on multiple I-485 filing.

Another option will be utilize consular processing with your approved I-140 especially with your current PD.

You may not need to file another I-485. If you applied through lawyer -- ask your lawyer to interfile your and your spouse's I-485 with your approved EB2 I-140. It will save you time and money.
