new_horizon09-27 09:26 PMmc cain will bring the war to an end but it'll be in victory, and making sure there'll be be no need for any future war in the region. but barack's knee-jerk pull back would not only undermine the war, it'll lead to unrest, and potential problem in the future to which the US will be drawn into again. you have seen the same problem india has been facing from the same terrorists...if you just hurt them they'll keep coming back. but if you destroy them forever you can bring peace.
I do agree that the times have been bad in the US economy lately, but don't you realize it's mainly due to the housing market, which has had a cascading effect on the banking sector, etc. (again this crazy financing scheme started in the clinton years where their objective was to give the dream of owning a home to the less fortunate to show that they are for the poor. this led to people getting easy loans to buy bigger home even if they didn't have the ability to pay back. the repubs did not have the courage to stop this lending practice, 'coz if they did the dems would say the repubs are against poor people buying houses. so you see how the dem policies hurt even long after they are gone).
but if you closely look, the US exports have boomed than any other time, and there is a huge chance of recovery if the right policies are applied. It's nice to imagine/hope that things will change overnight under the dems, but if you really look at their policies, they want to impose more taxes on the businesses (and also you), which will impact their bottomline, and will lead to a recruitment freeze, or even moving their business to a different country. and if you think our hard earned tax dollars are spent wastefully now, wait till you see how a dem admin is going to spend our money. they'll lead the country into deeper recession, and we can then kiss goodbye to our gc dreams.
I know the prospect of a charismatic guy in obama getting elected is very enticing, but the prospect of the dems controlling the house, senate, and the presidency will be a disaster never seen before. we'll see them lead US to a more socialistic country. what has made this country great is the prospect of getting limitless reward if you are hardworking, and innovative. but the dems concept is limiting reward to a set level, and distributing wealth to the less fortunate (i.e. lazy people). this was what happened to the socialistic and communist countries (dying economies, and poverty).
but our immediate concern is getting gc, and I really fear the prospect of dems controlling all branches of govt will def kill our dreams.

gcisadawg12-27 01:44 AMAlisa,

Thanks for your posts. I'm glad to have a decent exchange of thoughts with you. I agree with you partly that 'non-state' actors are responsible and not Zardari Govt.. But Who created the non-state actors in the first place? Instead of paying unemployment benefits, who offered them job portability to Kashmir? Their H1B shouldnt have been renewed at all after they came on bench. How can a parent not be responsible for the errant child? The world wants to neutralize the errant child....but for the parent a child is a child after all and that too the one that served its interests once. If this child is abandoned, can future child ( with same objective) be created with the same ease?

Those are the questions that are haunting many Indians on the forums.

But I salute you and other folks for keeping this conversation civil.

Kudos,
GCisaDawg

Macaca12-29 08:07 PMWatch Out for Russian Wild Card in Asia-Pacific (http://www.realclearworld.com/articles/2010/12/29/watch_out_for_russian_wild_card_in_asia-pacific__99333.html) By John Lee | Australian

Just before we were tucking into Christmas turkey and plum pudding, Russian President Dmitry Medvedev met his Indian counterpart Prime Minister Manmohan Singh in New Delhi to reaffirm what the Russian leader called a "privileged partnership" between the two countries.

By contrast, Australia sees little role for Moscow in the future Asian balance of power, where the former superpower was mentioned in passing only twice in the 2009 defence white paper.

But other countries are not making the same mistake.

If India is the "swing state" in Asia's future balance of power, as a prominent CIA 2005 report put it, New Delhi is well aware that Russia remains the wild card in the region.

Medvedev and Singh signed more than 20 agreements ranging from agreements to supply India with natural gas, reaffirming a commitment for a third Indian nuclear power plant to be built by Russian engineers, and the signing of a contract for the joint development of between 250-300 fifth generation fighter aircraft.

Over the next 15 years, it is estimated that every second overseas nuclear reactor built by the Russians will be in India, while New Delhi could be the destination for more than half of all Russian arms exports in the next five years.

It is no surprise that Russia is pulling out all the stops to court India.

After all, its two main exports - energy and arms - are exactly what India needs.

There is a long economic and strategic history of partnership between the two countries that began in the 1950s when the former Soviet Union and India became allies.

But just as Moscow sees new opportunities in a rising India, New Delhi still sees value in a declining Russia.

The problem for Russia is not just the collapse of the Soviet Union in 1991 and a patchy commitment to economic reform after the Boris Yeltsin era, but a declining population.

Russia has experienced periods of dramatic population decline before, from 1917-23, 1933-34 and 1941-46.

Since 1992, and despite the absence of famine or war, Russian deaths have exceeded births by a staggering 13 million.

With 141 million people now, numbers could be as low as 120 million by 2030.

Nevertheless, there are strong reasons to believe that Russia can play the wildcard role in Asia's future balance of power.

First, the common wisdom that Russia is moving closer to China in order to counterbalance America and its European and Asian allies and partners is incorrect, meaning that the Russian wild card is still very much in play.

While Russia is preoccupied with regaining its influence in parts of eastern Europe, Moscow is also warily watching China's unauthorised movements into Siberia and the Far East.

Beijing is about six times closer to the port city of Vladivostok than is Moscow, which has very weak administrative control over its eastern territories.

Already, an estimated 200,000 to 500,000 Chinese nationals have illegally settled in these oil, gas and timber-rich areas.

Beijing is also tempted by Siberia's freshwater supply, given that China already has severe shortages throughout the country.

The Russian Far East is inhabited by only six million people, while the three provinces in northeast China have about 110 million Chinese inhabitants. By 2020, more than 100 million Chinese will live less than 100km to the south of these Russian territories, whose population will then number between five million and 10 million.

As Medvedev recently admitted, if Russia does not secure its presence in the Far East, it could eventually "lose everything" to the Chinese.

The point is that Russia will have as much reason to balance against China's rise as encouraging it. As the godfather of geopolitics, Nicholas Spykman, put it, the key is to control the Rimland (Western, Southern and Eastern) Eurasia.

A small handful of long-sighted strategists in Washington, Tokyo, Moscow and New Delhi see potential for a grand alliance of convenience that can effectively constrain Chinese influence in Central, South and East Asia. How Russia plays its strategic cards in this context will go a long way in shaping Eurasia.

That Russia may choose to tilt the balance against China in the future is also backed by diverging world views of these two countries.

Should China continue its rise, Washington, Tokyo, New Delhi and Moscow will seek a favourable multipolar balance of power in Asia, even if it remains under American leadership.

By contrast, China sees the coming regional and world order as a bipolar one defined by US-China competition, with powers such as the EU countries, Japan, India and Russia relegated to the second tier, something that is very difficult for a proud "Asian" power such as Russia to accept.

Second, a declining Russia retains significant national and institutional strengths. For example, Russia will remain a legitimate nuclear military power with a large and pre-existing nuclear arsenal. It is also a genuine energy superpower and a global leader in advanced weaponry technologies.

These factors all but guarantee Moscow a prominent position in the future strategic-military balance.

Furthermore, Russia will retain its veto as a permanent member of the Security Council.

Given the difficulty of reforming the council, Moscow will continue to exercise a disproportionate influence through the UN, even if it continues to decline as a country.

Finally, Russia has that indefinable quality of seeing itself as a natural great power. This all adds up to Russia remaining a big player in Asia, with significant ability to influence, disrupt and complicate the plans of other great powers, even if it can no longer be dominant.

New Delhi and Beijing believe that Moscow is well position to remain Asia's wild card.

Australia should prepare for this as well.

axp81703-25 12:17 PMOh, and I think I should elaborate just a little more.

I am not asking whether the USCIS can or cannot exercise scrutiny on approving 485s where a person, under AC21 provision, switches to a small consulting company.

Of course they can, the 485 is for a full time job, and whether a job with a small consulting company is of a full time nature or not, is up in the air and they can 'scrutinize' it all they want, if they choose to.

My question to UN is whether he thinks if they will choose to go after 485 AC21 job switches to small consulting companies like he thinks they will for small consulting company H-1Bs, and not whether they can.

Thanks again,

crystal08-03 06:09 PMSearch the threads there is a link , if you entered to US in less than a year before filing I-485 they wil send a copy of G-325a to Consulate. If they dont get response in 6 months they move forward, they dont wait for the response. this does not cause backlog as far as i know. They keep consulate visa interview forms for an year , thats what i read in the link

Ok . here is the link

http://www.imminfo.com/resources/cis-sop-aos/7-3-3.html It is 60 days ( not 6 months which i said above)

Do you really think they would send the G-325a to the consulate? Do the consulates keep all the records? For how long? I heard from immigrationportal, somebody said they only send G-325a to the consulate if one applied a visa within one year prior to AOS application. Can anyone confirm this?

If they send everyone's G-325a form to the consulates, would that result in another backlog? Thanks.

485Mbe400108-05 04:35 PMDude..if the rules for EB2 eligibility were followed to the T, most of the EB2 jobs would fall back to EB3. Stop the holier-than-thou postings, it is your first post. you were able to apply in EB2 good for you, you might dissaprove the post bit that is ok with me. you want to file a lawsuit sure go ahead, i also want a file a lawsuit with the FBI for messing up my name check, easier said than done.

I have been in this mess since 2001, i have seen cases where jobs are modified to suit the resume and resumes are modified to suit the job and most of those guys have GCs by now.

Instead of getting emotional if we look at the point Rolling_Flood is trying to make, it makes perfect sense.

I don't see why there are so many angered arguments...

1. EB2/EB3 is decided by Job Profile - correct. Its always option to say NO if your employer is filing it in EB3. My previous company wanted to file my labor in EB3, I said NO and left them. Filed in EB2 with new employer.

Its easy to be sympathetic with people whose employer filed them in EB3, but remember they always had option to say NO.

2. If someone have EB3 priority date before other guy who filed EB2 from beginning, the porting EB3 to EB2 and getting ahead of EB2 guy is grossly incorrect. I can't believe USCIS lets this happen.

If someones job profile was eligible for EB3 only when they filed and now fits in EB2, they should file fresh application based on EB2 job profile.

Looking at previous trashing of thread opener, I am expecting lots of reds - so go ahead but that not going to change the truth.

mrajatish07-08 10:35 AM1. 245(k) is applicable automatically for all eb I-485. There is no penalty fee for 245(k).

2. Each I-485 application is independent for out of status issues. Does not matter Primary or Dependent.

3. Needs more information. A person can be out of status even with pay-checks. Example: H-1B LCA location is different from actual job location, putting him/her out of status.

_____________________
Not a legal advice.
You are right about the dependent/derivative thing - it was my misunderstanding.

The USCIS field manual on this: http://www.immigrationlinks.com/news/USCIS%20Training%20Materials%20on%20Sec%20245(k).p df

Best explanation I found: http://www.greencardapply.com/news/news05/news05_0825.htm

245(k) reads:

"(k) 7/ An alien who is eligible to receive an immigrant visa under paragraph (1), (2), or (3) of section 203(b) (or, in the case of an alien who is an immigrant described in section 101(a)(27)(C), under section 203(b)(4)) may adjust status pursuant to subsection (a) and notwithstanding subsection (c)(2), (c)(7), and (c)(8), if--

(1) the alien, on the date of filing an application for adjustment of status, is present in the United States pursuant to a lawful admission;

(2) the alien, subsequent to such lawful admission has not, for an aggregate period exceeding 180 days--

(A) failed to maintain, continuously, a lawful status;

(B) engaged in unauthorized employment; or

(C) otherwise violated the terms and conditions of the alien's admission."

Unauthorized Employment
Subject to INA 245(i) and 245(k), applicants for adjustment of status who have engaged in unauthorized employment on or after January 1, 1977 are barred from adjustment of status pursuant to INA 245(c)(2). Unauthorized employment is a bar to adjustment of status to persons who engaged in unauthorized employment even after their adjustment application was filed. This bar does not apply to employment-based petitions where person worked no more than 180 days without permission since his last entry into the U.S. [INA 245(k)]. Immediate relatives and special immigrants described in INA 101(a)(27)(H), (I), (J), or (K) are also exempt from this bar.

How do I know who gave me the red's?

There are some people here who will indulge in tarnishing your reputation when they do not agree with your post. I gave you green to get your reputation back or enhanced. I think your post was very respectable and a free opinion and it did not deserve any red dots.

akela_topchi01-09 06:16 PMDespite of several warnings by Israel, Hamas (that is elected by Palestine people) was launching rockets on the civilian population of Isreal. (and hardly any in Islamic world condemned it)

What were they thinking? They were just provoking Israel, and when it retaliated, suddenly all those Palestine and Hamas sympathizers are crying foul asking for mediation and intervention. I would say Israel has a right to wipe out any element that was involved in attacking their civilian population.

If some cowards are hiding behind their own women and children and launching attacks, rockets on Israelis then shouldn't they be asked to stop using innocent civilians for cover and fight like soldiers?

lskreddy12-27 09:52 PMAs much as terrorism is an evil thing, surgical strikes and stuff won't do crap. It will further alienate and give fodder to the mullahs to create more Kasab's. Really, do you think we can stop 20 yr old guys who are willing to kill themselves, think again? These guys are just washed out completely, there is no retribution, pain, all they see is a target and blow themselves out.

Instead, we should concentrate on the war within that we face. Be it from communal/political/socio-economic violence or lack of regard for the common man's life. By no means I am saying inaction but war is certainly not the solution. Pakistan will meet its fate sooner than later if they continue the path they have chosen. We don't have to hasten it.

200 Indians dying is painful but look at these figures to put things into perspective.

Accidents in India:
http://morth.nic.in/writereaddata/sublinkimages/table-6408184011.htm

AIDS
http://www.avert.org/indiaaids.htm

Infant Mortality:
http://www.indexmundi.com/India/infant_mortality_rate.html

Rapes
http://keralaonline.com/news/india-ranks-rape-cases_12144.html

These are all staggering numbers and something none of us have to depend on a third country to seek the cure.

I hope India continues to apply diplomatic pressure and show the world the parasite Pakistan it has become. As Zardari today acknowledged, they have a cancer within the country, its eating up. If they don't, its just a matter of time. To cure that, if they find mullahs as their doctors, time will be up pretty soon..

alisa01-03 02:36 PMTomorrow the Bombay attack is old too.
You are right. And so it is imperative that before that happens, the perpetrators and their handlers are hunted down, exposed and punished, in a credible and transparent manner.
Pakistanis should want to know who is trying to provoke India, and risking a war in the subcontinent, and why.

You are so good at giving advice to people who suffered at your country men's(like don't start war etc) hands and yet you don't own any responsibility.
What apology?
I am not responsible for the actions of those people. Imagine if after 9/11, an American asked you to apologize for the actions of the 19 'Brown men' (I am assuming here that you are a south asian male) who killed 3000 Americans, how silly do you think that situation would be. If cockroaches from my house take a dump in your kitchen, don't ask me to apologize for that.

xyzgc12-22 03:16 PMWell, one thing I can think of is how we treat the dead terrorists. In case of Parliament, Ashkardam and Mumbai attack, security forces killed the terrorists while they were killing innocents. As usual, Pakistan disowned them.
Publicise very very heavily and spread the word that these dead bodies would be given non-islamic burial. Hit where it hurts them...After giving non-islamic rites, spread the word that next terrorist that gets killed would get more drastic treatment.

BUT ensure that this treatment would be only for the foreign terrorists who are killed by security forces while doing their act and that are disowned by their country. It can be easily misused also. This should ONLY be done if nobody claims ownership of the body.

The story we hear about Kasab is that he was a looser and a petty criminal who was brainwashed. If he and his ilks are willing to get brainwashed religiously then they can not discount the effect of propaganda about non-islamic rites for their dead body and possibly it might deter them from taking that ultimate step.

Take a survey among the Muslims in Bombay to see if they support giving non-islamic rites for the 'orphaned' dead terrorists. I'm sure most of the sensible Muslims are outraged and they would agree to it especially after seeing what they saw on the TV. Before the killer's gun, there is no religion but only the intention to kill.

Publicity is a good potent weapon, I agree.

buehler07-18 07:09 AMhi Guys,
I was thinking over this for quite some time. Why dont we hire one or two immigration attorneys on a full time basis. And lets start am immigration office where we can have all our immigration works (doubtful) but the future immigrant works ata marginally cheaper rates with high quality of service. If we keep a no profit no loss mantra, it would be helpful to everyone and also it will make this organization very strong.
Lets discuss its relevance? What does the Core think about this.?

reddiv,

I know how happy you when you came up with this idea, but do you really have to cross post it in so many different threads and forums? In what way is it relevant in this particular thread?

Refugee_New01-06 03:02 PMIsrael is fully justified in responding to the rocket attacks from Gaza. How long can they show restraint by not responding to the unprovoked attacks. Do you think US will remain silent, if Canada were to lob rockets into US. Asbolutely not. Every country has the right to protect itself.
Hamas is such a coward orgn that they hide behind school, mosque, hospitals to shoot their rockets, so they really are luring israel to bomb those areas. Unfortunately innocents die...the blame should be on hamas. In fact, before bombing Israel even goes to the extent of calling and texting people in the target area to warn them before bombing. which country at war you know does that. Inspite of all these the biased media portrays Israel as the evil one. time to think. if only india shows some courage like that.

Another muslim hater who justify organized crime and killing and support the killing of innocent school kids and civilians.

Hiding behind civilians and schools and mosques???? Don't you hear the same lie again and again year over year? If Hamas is using school kids as thier shield, then how do you think Palestenian people have elected the same people who cause their kids death rule their country?

Don't you think?
