that's how infy, wipro, tcs work...they get ppl here on H1 and get paid in dollars....once they go back to india, they get paid in rupees....u need h1 if ur in the US.

senthil01-13 08:04 PMmasala_dosa, this is my understanding. once you have applied for EAD, its your responsibility to keep it valid all the time, independent of if you are using the EAD or NOT. You have to appy for renewals before it expires etc. i dont know if it impacts the current gc process or not.

two scenarios:

If you are using EAD for your current job, and if you did not renew ( or alteast file for renew) before it expires you may notbe able to continue the job.

If you are NOT using EAD, but have an EAD on hand you are supposed to keep it valid.

once again - im not an attorney and all above were my understanding.
why dont you talk to your attorney. he/she may have a simple answer for this.

Make sure you check Yes in the colmn "Have you ever been arrested". Voluntarily present the case dismissal documents.
Make sure you go to the appointment as soon as you land, If they say they will need to look into the case(It will take 3 weeks). They will not give your passport back when this process of "Look into it" happens. So you cannot travel back to US when Consulate takes time.
If the Consular officer is satisfied with the documents you have presented to him. In my case i had to produce case dispositions. Misdemenour is not a "InAdmissible" Offense even if you are convicted. made it back with 3 year stamping "Jai Ho"

Try the following:
1) Talk to your lawyer and see if contacting your local congress person would help you.
2) Post in other forums as well such as murthy.com and immigrationportal.com.

Good luck. The whole GC process is very stressful when everything is progressing without a hitch. So, I cannot imagine how much more stressful it must be when things get screwed by BEC and/or USCIS.

I am under Eb2 with priority date of Jan 2007 (labor and I140 approved) waiting for date to be current so that I can file I485 AOS....

My wife wants to convert from H4 to F1 for coming Spring 2011 so that she can take assistantship..

Is it advisable to change status to F1 with priority date so close..? does it cause any problems for her I485 application since F1 status is Non-immigrant category..

Please advise..

itsmesabby05-13 01:43 PMUSCIS site has been having some trouble for the past couple of months. The reciept numbers are all valid but are not displaying any status in the system. I had the same challenge with one of my applications. So when I called the rep could also not find the status online, but then they connected me to another rep who could check all my status and confirmed that the application was in the system and even notified me of the status.

Since only the petionter can make an inquiry in the status of an H1-B application, pls work with your HR to call the USCIS and get the information. You will be fine , don't worry.

Now the PERM takes 2years... whats the difference for new guys? My friend stuck in labour for almost 15 months now. got RFE, replied to it and stood stand still..

But this helps for someone who filed during July'07 fiasco and waiting though. I got mine approved in late feb'09 (filed in July 07).

Something is better than nothing.... :-)

Presumably your employer has a lawyer who can advise on whether an appeal might be successful. It is very likely that the denial was based on there not being the correct "employer-employee" relationship. CIS issued a new memo on this last month, and there are many threads in this forum on the topic.
