reddymjm06-19 05:00 PMI am sorry to ask...If H1B doesn't have I-94 attatched to it and it was approved when my friend was in india, he can work on L1. My question is, if he moves out of country and get H1B stamped, can he work on L1?

As it is not a change of status. If he gets it stamped on his passport and enters the county on H1B. YES he can. I strongly recommend to get his visa stamped in India until unless he has a US degree.

Can someone give me a brief idea as to how long it takes for the USCIS to respond to an MTR? I think I read somewhere that they respond within 60 days. Is that accurate? My MTR was filed 2 months back & I have not yet heard back from the USCIS. It was filed at TSC.

MTRs can take months or years. There is no 60-day processing time. The prior poster's answer of a few years is not unusual.

sxk06-29 03:24 PMI am currently using my EAD and working for a company remotely from my house. I also have a Permanent Resident Status in Canada. I can work remotely from Canada and my company will not have any objections to it.

Since I am on 485/EAD can I work for a US company and be on their pay roll and live in Canada? What are the ramifications?

Is there anyway, I can expedite my labor certification, I-140 approval and I-485 through my new employer on the basis of the previous approvals? I have a PD of jan'04. I know I retain my PD due to the I-140 but I wanted to know if there is anyway to not wait for the time it takes to get approval on LC and I-140.

My 6th year H1 expires in Feb'07 and company is ready to apply 7th year extension using premium processing. Assuming I get H1 extended by Oct 1st and travel to India in Nov for 2 weeks, is there a problem in coming back with old visa.

Since the appointments are full for the next 6 months I don't have any realistic chance of getting new stamping done during the trip. I know traveling while extension is pending is a big NO NO but if extension is approved am I allowed to use the old visa stamp?

rameshms10-24 02:08 PMI received RFE's on the AP application for myself and my wife in the last week of September. We received our Fingerprinting notices the following week. We had our Biometrics done on October 12th. As far as my experience goes, I do not think RFE on AP should adversely affect the receipt of fingerprinting appointment notices.

my EAD is expiring on XX/XX/2010. The new compnay wants me to join on YY/YY/2010. My questions are


1. IF 15 after joining new Compnay, I apply for EAD renewal and before filing for AC21,Will it create a problem. Since I can only file EAD renewal 4 month before expiration date I need to do it some where in april.

2. In case my Old employer revoke 140 before I file EAD renewl and AC21 will it create a problem?

I filed my 485 on July 5, 2007 at NSC and got my receipt number yesterday. I sent my wifes 485/765/131 on July 24, 2007 to NSC. She is on H4 currently. TOday i got my wifes receipt numbers for all 3. But to my surprise the receipt numbers were given by TSC instead of NSC.
FYI my 140 is pending with NSC.
I am just wondering if this will be a problem? Any one had been through similar situation?
