My husband's company lawyer already filed our I-485 but I made a mistake in entering my present company detail. Basically, I'm in H1 also and my transfer is still in process , so the present company detail I entered was for my old company not my new company ( which is still in process but I already got the receipt number). I didnt' know at the time of filing which company to enter that's why. Sorry, for being clueless but I really need your advice. Thank you.

You can also start but it is more complicated since your business has to be doing excatly the same thing as your labor application. Also, i think you should get lawyers advice if you are starting it. There is no complication for your wife to start a business.

NIW bypasses LC requirements, but you need to make a strong case for why your advanced qualifications/expertise will serve the interests of US society in the long term, a task often better handled by a competent immigration attorney. EB-1 is similar to NIW in terms of eligibility requirements, but USCIS uses a stricter microscope to approve EB-1 cases, again something an experienced attorney can help with.

If 5 years is really the requirement, and if you are an electrical engineer, or have an EE degree, TWC usually gives this designation. It is difficult to overcome this. Your friends who had lower prevailing wages must have been in different locations or had different occupations, or both. If your lawyer has lots of experience doing PERM, you can probably trust him.

I have a certain queries regarding the transfer from L2 to H1B.

My husband is on L1 and me on L2 with my EAD still under processing. However my husband's firm wants to get his visa converted to H1 which automatically cancels my L2 status and I would have to apply for H4.
So now my query is for how long will his status of L1 be valid will it be till the start date of H1B, or the minute he files in his papers for H1B or when his H1B gets approved?

Is there any way we can check our labor processing status as it is a genral fact that no employer would prefer to give his employee to access his status and at the same time they would not let employee to call attorney directly.So in this kind of scenario I was just wondering is there anyway we can track the status.

Unfortunately the answer is No.

You will have to wait (and trust) for your employer/attorney to give you this info.

Also you can check on the current perm processing dates which the USCIS issues I think every 3 months to see
how far the queue has moved and if you know approx date when your labor was filed you can make a guess
based on the published date and your filing date

I planning to change my employer after 180days and I want go for the fulltime by using my EAD because my I-485 will take next 3 or 4 years (PD May-2007). My present H1 is still Oct 2008 (labor and I-140 cleared).

1. What are the chances for rejecting my I-485 file?
2. If my I-485 file rejected after my H1 expired (EAD using) ?
3. How to settle out this ? Do I need to go back india?

Seniors please provide me suggestions.
